SUBJECT:   SAWS Reimbursement-Hemisfair Park-Yanaguana Garden Project
 
 
 
SUMMARY:
 
An ordinance authorizing a reimbursement to be received to the City of San Antonio from SAWS for the joint-bid of sewer and utility work associated in the construction of the Yanaguana Garden Project in the amount of $179,717.40 and related to the Hemisfair Park Project,  a 2012-2017 General Obligation Bond funded Project, located in Council District 1.
 
 
BACKGROUND INFORMATION:
 
The voters approved 2012-2017 Bond Program which included four (4) projects totaling $15 million for Parks, Recreation and Open Space Improvements at HemisFair Park.  The projects are: 1) Hemisfair Play Escape Project (Yanaguana Garden); 2) Magik Theatre Restoration; 3) Historic Homes and 4) The Civic Park.  All are located within the HemisFair Park.
 
The Yanaguana Garden Project is being constructed to be high density play area within Hemisfair Park for people of all ages. Construction of the initial site work includes demolition of outdate and dilapidated park amenities and providing upgrades to the infrastructure necessary to support and accommodate the improvements for core framework of the project. Improvements such as open park space, plazas, climbing structures, water and sand play elements, new restrooms and a shaded promenade connecting these elements are part of the project.
 
A previously executed Construction Manager at Risk (CMR) contract with Joeris General Contractors, Ltd., for construction of  Yanaguana Garden (HemisFair Play Escape Project) was approved by City Council on June 20, 2013 in the amount of $3,981,450.00, of which $179,717.40 will be reimbursed to the Project by SAWS for sewer and utilities work associated with the project. This scope of work was designed to be included in the Construction Manager at Risk construction work and was jointly bid with SAWS as part of the Guaranteed Maximum Price (GMP) process, in which cost is subsequently reimbursed by SAWS.
The SAWS Board of Directors reviewed this joint bid participation in their March 3, 2015 Board meeting, in which SAWS Board expressed its support and approved the scope of work and reimbursement to the City and Project.
 
ISSUE:
 
This action approves an ordinance authorizing a reimbursement to the City of San Antonio from SAWS for the joint-bid of sewer and utility work associated in the construction of the Yanaguana Garden Project in the amount of $179,717.40 and related to the Hemisfair Park Project,  a 2012-2017 General Obligation Bond funded Project located in Council District 1. This scope of work was designed to be included in the Construction Manager at Risk construction work and was jointly bid with SAWS as part of the Guaranteed Maximum Price (GMP) process, in which cost is subsequently reimbursed by SAWS.
 
Construction on the Project began in August 2014 followed by the major infrastructure construction operations in October 2014 and estimated to be completed by July 2015.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to authorize reception of this reimbursement and instead direct staff to implement an alternate funding method to accomplish this work. However, an alternate implementation process would excise a fiscal burden on the Project budget while adversely affecting the timely completion of this Project.
 
 
FISCAL IMPACT:
 
This ordinance authorizes the reimbursement of $179,717.40 to the City of San Antonio from SAWS to the 2012-2017 General Obligation Bond Program Hemisfair Park Project included in the FY 2015-FY2020 Capital Improvements Program.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance authorizing a reimbursement to the City of San Antonio from SAWS for the joint-bid of sewer and utility work associated in the construction of the Yanaguana Garden Project in the amount of $179,717.40.
