Contract Award: Ray Ellison Blvd (Loop 410 to Old Pearsall Road)
 
 
SUMMARY:
 
Consideration of the following actions related to the Ray Ellison Boulevard from Loop 410 to Old Pearsall Road Project, an approved 2012 - 2017 General Obligation Bond -funded project located in Council District 4:
 
A)      An ordinance for the construction of Ray Ellison Boulevard, from Loop 410 to Old Pearsall Road, accepting the lowest responsive bid and awarding a construction contract in the amount of $19,133,823.56, to Texas Sterling Construction, a 2012-2017 Bond-funded Project, located in Council District 4. Of this amount, $968,089.26 will be reimbursed by San Antonio Water Systems (SAWS) for its work and $2,892,478.00 will be reimbursed by CPS Energy.
B)      An ordinance amending the Professional Design Services Agreement with Pape Dawson Engineers in the amount not to exceed $150,000.00 supplemental construction phase engineering services related to the Ray Ellison Boulevard from Loop 410 to Old Pearsall Road Project.  
 
 
BACKGROUND INFORMATION:
 
Project Background
The 2012-2017 General Obligation Bond Program authorized $22,200,000 for funding of Ray Ellison Boulevard, from Loop 410 to Old Pearsall Road, and of that, $15,273,256.30 will be used for construction.  The balance of the Project funds approved by voters will be used for design services, environmental services, advertising, property acquisition and project management.
 
This Project provides for the reconstruction and widening of approximately two miles of Ray Ellison Boulevard, from Loop 410 to Old Pearsall Road, to four travel lanes with curbs (flush and raised), 6-foot sidewalks, 5-foot bicycle lanes, driveway approaches, various Low Impact Development (LID) features, underground drainage and traffic signal improvements. An additive alternate will include 800-ft underground drainage improvements along Walnut Valley from just north of Gold Valley to Ray Ellison.  Improvements for SAWS water, SAWS sewer and CPS gas also will be included with the project.  Ray Ellison Boulevard currently is a four lane roadway in front of South San ISD and Shepard Middle School and two lanes through the remainder of the project.
 
Procurement of Services.
A.      This Project was advertised for construction bids in the San Antonio Hart Beat, on the City's website and the Texas Electronic State Business Daily in February 2015. In addition, the bid announcement was made on TVSA and through the TCI Small Business Office. Plans also were available for review by potential bidders at the office of Pape Dawson Engineers, located at 2000 NW Loop 410, San Antonio, TX 78213.  Bids for this Project were opened on March 31, 2015 and five (5) bidders responded. Of these, Texas Sterling Construction submitted the lowest responsive bid. A matrix of the bid outcome is included herein as Attachment 2.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set an 18% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 2% African American Business Enterprise (AABE) subcontracting goal.  The Economic Development Department approved a partial waiver submitted by Texas Sterling Construction because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.  This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
B.      This amendment in the amount not to exceed $150,000.00 to the Professional Design Services Agreement with Pape Dawson Engineers is for additional construction phase services related to the Ray Ellison Boulevard Project. These services will provide for additional Construction Phase Services.
 
In May 2012, three (3) Requests for Qualifications (RFQs) were released to seek professional design services in connection with the 2012 Bond Program, specifically: 1) Architecture, 2) Landscape Architecture and 3) Engineering. On June 8, 2012, the City hosted a kickoff meeting attended by more than 500 individuals. This kickoff meeting served as the official pre-submittal conference for all three RFQs. In July 2012, 118 Statements of Qualifications were received and evaluated by representatives from CIMS, Public Works, Library, Human Services, SAWS, CPS and outside experts. The highest-ranked consultants were matched with appropriate projects. On October 11, 2012, Council approved the mass selection of (41) professional service contracts for Engineering Services associated with the 2012-2017 Bond Program. Pape Dawson Engineers was one of the firms selected to provide engineering services.  
 
Previous Council Action
A previously executed contract with Pape Dawson Engineers in the amount of $1,542,771.20 was approved by City Council on October 11, 2012, through Ordinance 2012-10-11-0794.  This amendment will increase the contract by $150,000.00 to a contract amount of $1,692,771.20.

ISSUE:
 
A)      This ordinance accepts the lowest responsive bid and awards a construction contract in the amount of $19,133,823.56, authorized payable to Texas Sterling Construction, for construction of Ray Ellison Boulevard, from Loop 410 to Old Pearsall Road, a 2012-2017 Bond-funded project, located in Council District 4. Of this amount, $968,089.26 will be reimbursed by San Antonio Water Systems (SAWS) for its work and $2,892,478.00 will be reimbursed by CPS Energy.
 
This contract provides for the for the reconstruction and widening of approximately two miles of Ray Ellison Boulevard, from Loop 410 to Old Pearsall Road, to four travel lanes with curbs (flush and raised), 6-foot sidewalks, 5-foot bicycle lanes, driveway approaches, various LID features, underground drainage and traffic signal improvements. An additive alternate will include 800-ft underground drainage improvements along Walnut Valley from just north of Gold Valley to Ray Ellison.  Improvements for SAWS water, SAWS sewer and CPS gas also will be included with the project. Project construction is anticipated to begin in May 2015 and is estimated to be completed by March 2017. Construction activities will take place six days a week, sun up to sun down.
 
B)      This ordinance approves amending the Professional Design Services Agreement with Pape Dawson Engineers in the amount not to exceed $150,000.00 for additional construction phase services related to the Ray Ellison Boulevard from Loop 410 to Old Pearsall Road Project.
 
Due to the size and nature of the Ray Ellison project, special inspections by the design engineer will be required to ensure the improvements are constructed in strict conformance to the plans and specifications.
 
 
ALTERNATIVES:
 
A)  As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project.
 
B)  As an alternative, City Council could choose not to approve these additional services; however, that would adversely affect the timely completion of the Ray Ellison Boulevard from Loop 410 to Old Pearsall Project.
 
 
FISCAL IMPACT:
 
A)  This is a one-time capital improvement expenditure in the total amount of $19,133,823.56, payable to Texas Sterling Construction. Of this amount, $968,089.26 will be reimbursed by San Antonio Water Systems for its work and $2,892,478.00 will be reimbursed by CPS Energy.  Funds are available from the 2012-2017 General Obligations Bonds and are included in the FY 2015 - 2020 Capital Improvements Program Budget.
 
B)  This is a one-time capital improvement expenditure in the amount not to exceed $150,000.00, payable to Pape Dawson Engineers, to provide additional engineering services related to the Ray Ellison Boulevard Project.  Funds are available in previously authorized 2012 General Obligation Bond funds and included in FY 2015 - 2020 Capital Improvements Program Budget.
 
 
RECOMMENDATION:
 
Staff recommends approval of the following actions related to the Ray Ellison Boulevard from Loop 410 to Old Pearsall Road Project, an approved 2012 - 2017 General Obligation Bond -funded project located in Council District 4:
