SUMMARY:
 
An ordinance for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project, a 2012 General Obligation Bond and $1,745,608.80 federally funded project from TxDOT, located in Council District 4, awarding a construction contract in the amount of $8,078,660.90 to Shannon Monk of which $1,093,954.00 will be reimbursed by San Antonio Water Systems (SAWS), and $148,464.50 will be reimbursed by CPS Energy and reallocating $1,044,151.00 in 2007-2012 General Obligation Street Bond Savings to this project.
 
BACKGROUND INFORMATION:
 
Project Background
 
The 2012 General Obligation Bond authorized $6,000,000.00 for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell ) Project. The 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project provides the reconstruction of the roadway, sidewalks, curbs, a shared use path and a drainage channel from Billy Mitchell to General Hudnell.  The existing roadway is a two lane roadway with curbs and the proposed roadway will consist of a four lane roadway with a concrete median, including sidewalks and a shared use path.  The drainage channel will be adjacent to the roadway.  Construction is scheduled to begin in July 2015 and scheduled to conclude in September 2016.  
 
Previous Council Action
On March 21, 2013, Council approved the Advanced Funding Agreement with the Texas Department of Transportation for the 36th St Phase IIIB (Billy Mitchell to General Hudnell) Project through Ordinance 2013-03-21-0172. As a Local Agency Management (LAM) project, the City must follow federal requirements to ensure reimbursement of an estimated $1,745,608.80 from TxDOT related to construction costs for the 36th St Phase IIIB (Billy Mitchell to General Hudnell) Project.
 
On March 13, 2014, Council approved an Interlocal Agreement with the Port Authority of San Antonio for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project through Ordinance 2014-03-13-0159.  The Interlocal Agreement provided payment in an not-to-exceed amount of $150,000.00 to the Port Authority associated with the costs in the City's use of the Port's design engineer for construction phase services during the construction of the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project.       
 
On February 12, 2015, Council approved an amendment to the Interlocal Agreement with the Port Authority of San Antonio for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project through Ordinance 2015-02-12-0104.  The amendment to the Interlocal Agreement provided payment in an not-to-exceed amount of $267,364.00 to the Port Authority for the movement/adjustment/replacement of communication lines for the City's use of the Port's design engineer for construction phase services during the construction of the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project.        
 
 
Procurement of Services
The Project was advertised for construction bids in the San Antonio Hart Beat, on the City of San Antonio's website and the Texas Electronic State Business Daily in February 2015.  In addition, the bid announcement was made on TVSA and through the TCI Small Business Office.  Plans also were available for review by potential bidders at the office of CEC, located at 11550 I.H. 10 West, Suite 395, San Antonio, Texas 78230.  Bids for this Project were opened on March 24, 2015 and three bidders responded. Of the responsive bids, Shannon Monk submitted the lowest responsive bid.  
 
The Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of SBEDA.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
ISSUE:
 
This ordinance for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) Project, a Metropolitan Planning Organization (MPO) / Federal Highway Administration and 2012 General Obligation Bond - funded Project and $1,745,608.80 federally funded from TxDOT, located in Council District 4, accepts the lowest responsive bid and awards a construction contract in the amount of $8,078,660.90, authorized payable to Shannon Monk, of which $1,093,954.00 will be reimbursed by San Antonio Water Systems (SAWS), and $148,464.50 will be reimbursed by CPS Energy and reallocates $1,044,151.00 in 2007 General Obligation Street Bond Savings to this project.   
  
 
This Project provides the reconstruction of a four lane roadway including medians, sidewalks, curbs, a shared-use path and a drainage channel along 36th Street from Billy Mitchell to General Hudnell.  Construction of this Project is scheduled to begin in July 2015 and is scheduled to conclude in September 2016.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.  In addition, the reimbursement of an estimated $1,745,608.80 from TxDOT related to the construction costs for the 36th Street Phase IIIB - (Billy Mitchell to General Hudnell) may be withdrawn if the contract is not awarded.  
 
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the amount of $8,078,660.90, payable to Shannon Monk. Of this amount, $1,093,954.00 will be reimbursed by San Antonio Water Systems (SAWS) and $148,464.50 will be reimbursed by CPS Energy. Funds in the amount of $1,745608.80 are available from a Federal Highway Administration grant passed through Texas Department of Transportation and the 2012-2017 General Obligation Bond and are included in the 2015-2020 Capital Improvements Budget. If approved by Council, this ordinance authorizes the reallocation of $1,044,151.00 from 2007-2012 General Obligation Streets Bond funds to the 36th Street Phase IIIB project.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance awarding a construction contract in the amount of $8,078,660.90 to Shannon Monk for construction of 36th Street Phase IIIB (Billy Mitchell - General Hudnell).
