Settlement of Northern Hills Management Company vs. City of San Antonio
 
 
SUMMARY:
 
This item will authorize the settlement of litigation styled Northern Hills Management Co. vs. City of San Antonio, Cause Number 2012-CI-09363 pending in the 166th Judicial District, Bexar County, Texas.  
 
 
BACKGROUND INFORMATION:
 
Northern Hills Management Co. brought suit against the City alleging adverse condemnation.  The City has contested these claims.  The parties have agreed to settle the litigation pending City Council approval for the amount of $6,300,000.00.  As a part of this settlement, the City will acquire the Northern Hills Golf Course.  City Council is also requested to authorize the operation of the Golf Course by the Municipal Golf Association - San Antonio, and provide one-time funding to MGA-SA for equipment related to the operations in an amount up to $500,000.00.
 
 
ISSUE:
 
Settlements over $50,000 require City Council approval.
 
 
ALTERNATIVES:
 
If this settlement is not approved by City Council, this case will proceed to trial.  It is in the best interest of the City to settle this matter to avoid the uncertainty and risks associated with litigation.
 
 
FISCAL IMPACT:
 
If approved, the settlement amount will be funded in accordance with the Adopted FY 2015 Liability Fund Budget and other budgeted funding.
 
 
RECOMMENDATION:
 
Staff recommends approval of this item.
