SUMMARY:
An ordinance for West Avenue Low Water Crossing, a 2012-2017 Bond funded project located in Council District 9, awarding a construction contract to J3 Company, LLC in amount not to exceed $5,129,869.30, of which $857,078.00 will be reimbursed by San Antonio Water Systems (SAWS) and $79,250.00 will be reimbursed by CPS Energy and authorizing a payment of up to $300,000.00 for project acceleration costs associated to incentivize the early reopening of West Avenue.
 
BACKGROUND INFORMATION:
Project Background
The 2012-2017 General Obligation Bond Program authorized $6,630,000.00 for funding of the West Avenue Low Water Crossing Project of which $4,193,541.30 will be used for construction.  The balance of the Project funds will be used for design services, environmental services, advertising and project management with any remaining funds to be realized as bond savings.
This Project will consist of the construction of a 322 foot long span bridge, the demolishment of existing low water roadway, the realignment of North Loop road due to the higher elevation of the bridge, sidewalks, driveways, and traffic signal improvements at Nakoma and West Avenue.  Construction activities will take place six days a week, sunrise to sundown.
During a portion of the construction phase, West Avenue will be closed to accommodate the construction of the span bridge.  During this road closure, a detour plan will be in place to accommodate pedestrian and vehicular traffic.  To limit the inconvenience to area residences and businesses, an amount not to exceed $300,000.00 is included in this contract for project acceleration costs on the condition that J3 is able to complete construction and open the bridge within six months from the day they close the road as stipulated in the contract.
Public Meetings were held on April 23, 2014, at Coker United Methodist Church to inform residents of the project scope and schedule.  Project construction is anticipated to begin August 2015 and estimated to be completed by February 2017.
Procurement of Services
 
An Invitation for bids was advertised in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, and through the TCI Small Business Office in April and May 2015. In addition, plans were available for review by potential bidders at the office of Halff and Associates, Inc., San Antonio, Texas 78256.  Bids for this Project were opened on May 5, 2015 and four bids were received.  Of these, J3 submitted the lowest responsive bid.  
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 12% Minority/Women Business Enterprise (M/WBE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by J3 Company, LLC because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.
 
ISSUE:
This ordinance for West Avenue Low Water Crossing, a 2012-2017 Bond funded project, located in Council District 9, accepts the lowest responsive bid and awards a construction contract to J3 in an amount not to exceed $5,129,869.30 of which $857,078.00 will be reimbursed by San Antonio Water Systems (SAWS) and $79,250.00 will be reimbursed by CPS Energy and authorizes a payment of up to $300,000.00 for project acceleration costs associated to incentivize the early reopening of West Avenue.

ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project.  
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the amount of $5,129,869.30, authorized payable to J3.  Of this amount, $857,078.00 will be reimbursed by San Antonio Water Systems (SAWS) and $79,250.00 will be reimbursed by CPS Energy.  This ordinance also authorizes a payment of up to $300,000.00 for project acceleration costs associated with additional overhead and overtime.  Funds are available from the 2012-2017 General Obligation Bonds and are included in the FY 2015 - 2020 Capital Improvement Budget.

RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount not to exceed $5,129,869.30 to J3 Company, LLC (J3), for construction of West Ave Low Water Crossing Project of which $857,078.00 will be reimbursed by San Antonio Water Systems (SAWS) and $79,250.00 will be reimbursed by CPS Energy and authorizing a payment of up to $300,000.00 for project acceleration costs associated to incentivize the early reopening of West Avenue.
