SUMMARY:
 
An Ordinance for the Upper Leon Creek Regional Storm Water Facility-Culebra Creek Natural Waterway Conveyance, a Storm Water Revenue Bond and 2007 General Obligation Bond funded Project, located in Council District 6, authorizing an amendment in the increased amount of $214,251.00 to the $1,952,175.00 Professional Services Agreement with AECOM Technical Services, Inc. for additional design services.
 
 
BACKGROUND INFORMATION:
 
Project Background
As part of the 2007-2012 voter approved Bond Program, $3,156,000.00 was allocated for the Upper Leon Creek Regional Storm Water Facility (RSWF) which was originally anticipated to be located within the Government Canyon State Natural Area.  As part of this project, a Due Diligence and Feasibility Study for Government Canyon RSWF was completed on several potential detention sites within Government Canyon.  Due to changes in floodplain conditions surrounding Government Canyon, it was determined the best options to reduce the risk of future potential flooding was to concentrate efforts on downstream projects. Therefore, three alternative projects within the Upper Leon Creek Watershed were identified and studied - Helotes Creek RSWF, Culebra Creek Natural Waterway Conveyance (NWWC), and Leon Creek NWWC.  
 
The Culebra Creek NWWC was determined to be the most cost effective and beneficial project because it is expected to remove 40 structures from the existing conditions floodplain. Therefore, the City is proposing to move forward with the Culebra Creek NWWC project at this time. This amendment will allow AECOM Technical Services, Inc. to complete the design of Culebra Creek NWWC Project as part of the Upper Leon Creek Regional Stormwater Facility project.
 
The Culebra Creek NWWC Project will include channel grading along Culebra Creek near Timber Path and Culebra Road to convey the 1% annual chance (100-year) existing conditions storm event.  
 
Previous Council Action
A previously executed contract with Turner Collie and Braden (TCB), now doing business as AECOM Technical Services, Inc., in the amount of $137,755.00 for the Upper Leon Creek Regional Storm Water Facility Project was approved by City Council on August 18, 2005 through Ordinance 101235.  Previously approved amendments in the total amount of $1,814,420.00 have increased the agreement amount to $1,952,175.00.  This amendment will increase the agreement in an amount not to exceed $214,251.00 for a new agreement amount $2,166,426.00.

ISSUE:
 
This ordinance for the Upper Leon Creek Regional Storm Water Facility-Culebra Creek Natural Waterway Conveyance, a Storm Water Revenue Bond and 2007 General Obligation Bond funded Project, located in Council District 6, authorizes an amendment in the increased amount of $214,251.00 to the $1,952,175.00 Professional Services Agreement with AECOM Technical Services, Inc. for additional design services.
 
From 2005 to 2013, there have been several studies conducted for the Upper Leon Creek Regional Storm Water Facility. The project has changed focus more than once due to environmental challenges as well as a change in priority for partner agencies. In 2007, when the contract was last amended, Government Canyon was still the chosen location for this project, therefore the amended amount did not take into consideration that this location would change. In 2013, Government Canyon was removed from consideration and alternative projects were proposed. The Culebra Creek NWWC was determined to be the most cost effective and beneficial project because it is expected to remove 40 structures from the existing conditions floodplain. Culebra Creek NWWC Project is a project identified in the Leon Creek Watershed Master Plan. Funding for the construction of this project is available, however the design needs to be completed in order to move forward.
 
The proposed amendment will provide for the design of drainage improvements along Culebra Creek near Timber Path and Culebra Road to convey the 1% annual chance (100-year) existing conditions storm event. Approximately 40 structures will be removed from the existing conditions floodplain.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to approve these additional design services; however, that would adversely affect the timely completion of the Upper Leon Creek RSWF-Culebra Creek NWCC Project.
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the amount of $214,251.00, authorized payable to AECOM Technical Services, Inc. Funds are available from Storm Water Regional Facilities Fund and 2007 General Obligation Bond Drainage funds and are included in the 2015-2020 Capital Improvements Program Budget.
 
 
RECOMMENDATION:
 
Staff recommends approval of a $214,251.00 amendment to the Turner Collie & Braden (dba AECOM Technical Services, Inc.) Professional Design Service Agreement for the Upper Leon Creek RSWF-Culebra Creek NWCC Project.
