SUBJECT:

Amendment to the License Agreement to Host UTSA Football Games at the Alamodome

SUMMARY:

This Ordinance authorizes an amendment to the Revised and Restated License Agreement with UTSA to host its football games in the Alamodome.


BACKGROUND INFORMATION:

Ordinance 2010-10-21-0901, approved October 21, 2010, authorized a License Agreement with UTSA to host its football games in the Alamodome for an initial term of five years, with two one-year renewal options.

Ordinance 2012-09-06-0676, approved September 6, 2012, authorized a Revised and Restatement to the Alamodome License Agreement extending the term from December 2017 to December 2035 and amended certain terms and conditions of the License Agreement to accommodate the longer-term agreement.

An Amendment to the current Revised and Restated Agreement with UTSA is necessary because the current agreement does not allow for the collection of the new service charge fee that is assessed on all tickets sold.

Under the terms of the Amendment to the Revised and Restated Alamodome agreement, the following conditions apply to tickets sold for the 2015-2019 football seasons:

* Service Charge will not be assessed for tickets sold but not redeemed
* Service Charge will not be assessed on tickets sold for $10 or less
* Incentive rebates for net tickets sold over 120,000 would apply



ISSUE:

These terms have been negotiated with UTSA Athletics in order to ensure the UTSA Roadrunners continue to increase the attendance at their football games and are able to grow their football program.


ALTERNATIVES:

Alternatives to the proposed action include not amending the current agreement with UTSA, and directing staff to renegotiate the terms of the amended agreement.
