SUBJECT:
Amendment to City Code of San Antonio, Chapter 14
SUMMARY:
An Ordinance amending Chapter 14 of the City Code, Solid Waste, to establish and add fees for the Pay As You Throw Solid Waste collection program to be implemented citywide.
BACKGROUND INFORMATION:
In 2013, City Council approved the Recycling and Resource Recovery Plan with the goal to divert 60% of single family residential waste from landfills by 2025. Programs such as Pay As You Throw (PAYT) and Organics Recycling are critical to achieve this goal. The FY2016 Proposed Budget includes the first phase of implementation for PAYT and Organics Recycling. This council action authorizes establishing and amending fees to the City Code of San Antonio, Chapter 14 to align with the upcoming PAYT Program.
ISSUE:
This Ordinance authorizes establishing and amending fees to the City Code of San Antonio, Chapter 14 to accommodate for the implementation of PAYT, including:
• Major Revisions to the Definitions Section
o Added: Pay As You Throw (PAYT)
o Revised: Container updated to describe three sizes of garbage carts with recycling and organics available in small and large sizes
• Major Revisions to Solid Waste Fees
o Elimination of organics subscription fee, $3.00 per month
o Maintain current fee structure for non-PAYT residents
o New fee structure for PAYT residents

• Major Revisions to Collections
o Non-Compliance Fee - service fee to empty a contaminated organics or recycling cart, $25.00 per occurrence
o Garbage Cart Upsize Fee - first time free, subsequent upsize is $25.00
o Extra Garbage Collection Fee - on call, $10.00 fee per occurrence, 3 times per year max.
o Additional recycling and organics containers will be provided at no charge if customer can demonstrate existing containers are being used properly
o Residents removed from recycling or organics programs due to contamination issues may be issued an additional brown cart and be assessed an additional solid waste monthly fee
Default container for collection assistance service (disability) is small, exceptions approved by director
ALTERNATIVES:
Should City Council not authorize this amendment, then the City would need to consider postponing and/or cancelling the implementation of Pay As You Throw.
FISCAL IMPACT:
The individual revenue adjustment items included herein propose to increase revenues within various City funds as outlined in the table below:
