Contract Award: UTSA Boulevard - (Babcock Road to Edward Ximenes Drive)

 

 

SUMMARY:

 

An ordinance for the UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project, awarding a construction contract in the amount of $7,362,272.00 to Texas Sterling Construction of which $447,371.00 will be reimbursed by San Antonio Water System (SAWS), and $293,476.00 will be reimbursed by CPS Energy, a 2007-2012 Bond savings and federally funded project, located in Council District 8. 

 

 

BACKGROUND INFORMATION:

 

The UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project provides the reconstruction of the roadway, sidewalks, curbs, bicycle lanes, and drainage from Babcock Road to Edward Ximenes along UTSA Boulevard.  The existing roadway has two lanes with curbs and will consist of a four lane roadway with a median and left turn lanes, sidewalks and a shared use path.  Construction is scheduled to begin in December 2015 and estimated to be completed in May 2017. 

 

Previous Council Action

On October 17, 2013, City Council approved the Advanced Funding Agreement with the Texas Department of Transportation for the UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project through Ordinance 2013-10-17-0714.

 

Procurement of Services
The Project was advertised for construction bids in the San Antonio Hart Beat, on the City of San Antonio’s website and the Texas Electronic State Business Daily in July 2015.  In addition, the bid announcement was made on TVSA.  Bids for this Project were opened on August 28, 2015 and four bidders responded. Of the responsive bids, Texas Sterling Construction submitted the lowest responsive bid. 

 

The Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of SBEDA.

 

This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

 

ISSUE:

 

This ordinance for the UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project, a 2007 Bond savings and federally funded project, located in Council District 8, accepts the lowest responsive bid and awards a construction contract in the amount of $7,362,272.00, payable to Texas Sterling Construction, of which $447,371.00 will be reimbursed by San Antonio Water System (SAWS), and $293,476.00 will be reimbursed by CPS Energy.  

 

This Project provides the reconstruction of a four lane roadway with a median, left turn lanes, sidewalks, curbs, a shared-use path and drainage along UTSA Boulevard (Babcock Road to Edward Ximenes Drive).  Construction of this Project is scheduled to begin in December 2015 and is estimated to be completed in May 2017. Construction activities will take place six days a week, from sunrise to sunset.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.   

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in the amount of $7,362,272.00, payable to Texas Sterling Construction. Of this amount, $447,371.00 will be reimbursed by San Antonio Water System (SAWS) and $293,476.00 will be reimbursed by CPS Energy. 

 

On October 17, 2013, Council approved the Advanced Funding Agreement with TxDOT for the UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project through Ordinance 2013-10-17-0714, authorizing acceptance of an estimated $10,266,608.00 in federal funds allocated to the City from TxDOT and administered by TxDOT as a federal pass through grant associated with the construction of the UTSA Boulevard Project. Because bids came in lower than expected, TxDOT is reducing its contribution to an amount up to $7,098,564.00 in accordance with the Master Agreement that provides for adjustments in funding based on the construction bids.

 

Funds in the amount of $7,098,564.00 are available from the UTSA TxDOT AFA in the UTSA Boulevard (Babcock Road to Edward Ximenes Drive) Project and are included in the FY 2016 - FY 2021 Capital Improvement Program.

 

With construction set to begin in December 2015, all project funding will be held within the project in anticipation of possible unforeseen costs. Any City funds remaining near the end of construction will be realized as savings and will be reprogrammed through the budget process.

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance awarding a construction contract in the amount of $7,362,272.00 to Texas Sterling Construction for construction of the UTSA Boulevard Project of which $447,371.00 will be reimbursed by San Antonio Water System (SAWS), and $293,476.00 will be reimbursed by CPS Energy.
