SUBJECT:

 

Advanced Funding Agreement: TxDOT FM 1560 Expansion Project

 

 

SUMMARY:

 

An ordinance authorizing the execution of an Advanced Funding Agreement between the City of San Antonio and TxDOT and authorizing payment to TxDOT in the amount of $60,110.00 for the City’s portion of right-of-way costs associated with the expansion of Farm to Market 1560 from State Highway 16 to Loop 1604, located in Council District 8.

 

 

BACKGROUND INFORMATION:

 

TxDOT plans to widen Farm to Market (FM) 1560 from State Highway (SH) 16 to Loop 1604 from a two lane roadway to a four lane roadway with a continuous left-turn lane, and bicycle and pedestrian accommodations.

 

In accordance with the Texas Administrative Code (TAC 43.01.15.52) “The local governments will provide necessary right of way and utility relocations and adjustments, whether publicly or privately owned, in accordance with TAC 15.55 of this subchapter (relating to Construction Cost Participation)”. The local participation for “Agreement to Contribute Right of Way Funds” is 10% for local governments and this equates to $60,110.00 for the acquisition of a portion of privately owned property on five parcels.

 

 

ISSUE:

 

This ordinance authorizes the execution of an Advanced Funding Agreement between the City of San Antonio and TxDOT and authorizes payment to TxDOT in the amount of $60,110.00 for the City’s portion of right-of-way costs associated with the expansion of FM 1560 from SH 16 to Loop 1604, located in Council District 8.

 

The planned improvements for FM 1560 include expanding the current two lane roadway to a four lane roadway with a continuous left-turn lane, and bicycle and pedestrian accommodations. Construction is anticipated to begin in July 2016 and estimated to be completed in October 2018.

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to approve the execution of this Advanced Funding Agreement to contribute right of way funds; however the Texas Administrative Code (TAC) requires the City to either participate in the 10% of the estimated right of way cost or acquire the needed right property and receive reimbursement. Considering the additional time it would require for City staff to acquire right of way on behalf of TxDOT, this would adversely affect TxDOT’s project.  

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in the amount of $60,110.00 authorized payable to TxDOT related to the expansion of FM 1560. Funds are available from 2007 General Obligation Bond savings.

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance authorizing payment to TxDOT in the amount of $60,110.00 for right of way acquisition related to the expansion of FM 1560 from SH 16 to Loop 1604, located in Council District 8.
