CPS Energy Change Order: Wilson Boulevard & Thespian Island
SUMMARY:
An ordinance for the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project, authorizing a utility-driven change order to E-Z Bel Construction, LLC, in the amount of $125,230.52 to be reimbursed by CPS Energy, a 2012-2017 General Obligation Bond Project, located in Council District 7.
BACKGROUND INFORMATION:
This Project provided the reconstruction of sidewalks and curbs on the west side of Wilson, from Club to Donaldson Avenue, and construction of a center concrete grassy median to provide pedestrian refuge and resurfacing along Wilson Boulevard, from Club Drive to Donaldson Avenue. Operational improvements made around Thespian Island included widening the existing island at Kampmann, to provide a dedicated right-turn lane to Donaldson while keeping the original island shape intact. Improvements for SAWS water, SAWS sewer and CPS gas also were included with the Project. Project construction began in June 2015 and was completed in October 2015. E-Z Bel Construction, LLC is a small minority-owned business.
Previous Council Action
A previously executed contract with E-Z Bel Construction, LLC for the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project, for $808,105.00 was approved by City Council on June 4, 2015, through Ordinance 2015-06-04-0479. Change orders have increased this contract by $76,795.37. This change order will increase the contract by $125,230.52 to a contract amount of $1,010,130.89.
ISSUE:
This item is an ordinance that approves a utility-driven change order, totaling $125,230.52, and authorizes payment to E-Z Bel Construction, LLC for the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project, a 2012 General Obligation Bond Project, located in Council District 7. The entire amount of this change order will be reimbursed by CPS Energy.
CPS Energy joint bid its improvements with the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project, which included the replacement of three gas mains, gas services and associated facilities. For proper installation of the gas main at Wilson Boulevard and within the Jefferson High School campus, the contractor required a wider trench than originally anticipated during design. The estimated quantities, included in the contract, did not capture the trench backfill and pavement restoration quantities required for the wider trench. This additional work was encountered during construction, and as an urgent unforeseen condition, was directly communicated between the contractor and CPS Energy. The City was notified of this change order after the project was completed and as EZ Bel was submitting their final payment. This change order compensates E-Z Bel Construction, LLC for its additional work on CPS Energy’s facilities.
ALTERNATIVES:
As an alternative, City Council could choose not to approve this change order; however, CPS Energy would have to find another means to pay E-Z Bel, LLC for their completed work. The most cost effective and least disruptive option is to approve this change order.
FISCAL IMPACT:
This is a one-time capital expenditure in the amount of $125,230.52 for the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project, made payable to E-Z Bel Construction, LLC. The total one-time capital expenditure of $125,230.52 will be reimbursed by CPS Energy.
RECOMMENDATION:
Staff recommends approving this change order, in the amount of $125,230.52, for the Wilson Boulevard (Club Drive to Donaldson Avenue) & Thespian Island Project.
