ANALYSIS:


Variance Request:
One March 16, 2016, the applicant requested a variance from Section 35-F124 (e) and (f) (20) of the Unified Development Code (UDC). The TCI Department, Floodplain Management Division has no objection to the granting of the variance as indicated in the attached report (ATTACHMENT #1).

FEMA Study:
A CLOMR was prepared to bring the subject site into compliance from previous floodplain violations as well as to propose channelization of Beitel Creek associated with an approved City Ordinance 88045. The study has shown to reduce water surface elevations within Beitel Creek and proven no adverse impact to adjacent properties. Mitigation is required by the U.S. Army Corps of Engineers as the subject site was found to have wetlands.

It is noted that a Floodplain Development Permits (FPDP) will not be issued until a CLOMR flood plain study is approved by FEMA. In addition, a Letter of Map Revision (LOMR) must be prepared and approved by FEMA indicating the as-built conditions for the said channel improvements to Beitel Creek to release any building permits for approval.
