Disposition: Closure of an alley portion of Public Right of Way located between North New Braunfels Avenue and Breezewood Drive
SUMMARY:
A resolution closing, vacating and abandoning 0.0489 acres of an alley portion of Public Right of Way, located between North New Braunfels Avenue and Breezewood Drive, in Council District 10, as requested by Equity Ventures Commercial Development, L.C., for a fee of $11,800.00.
BACKGROUND INFORMATION:
Equity Ventures Commercial Development, L.C. (Petitioner) is requesting the closure, vacation and abandonment of an alley portion of Public Right of Way located between North New Braunfels Avenue and Breezewood Drive as shown on attached Exhibit A. The Petitioner plans to demolish the old building on its abutting property at 6514 North New Braunfels Avenue and construct a new building for a Natural Grocers Store. Because the partial closure would legally, create a dead-end of the remaining alley, the Petitioner has agreed to dedicate an alley out of their adjacent property as shown on the Exhibit, to maintain thru access. The alley dedication would be immediately north of the existing proposed closure and would encompass 0.0771 acres.
ISSUE:
This resolution will support the closure, vacation and abandonment of 0.0489 acres of an alley portion of Public Right of Way, located between North New Braunfels Avenue and Breezewood Drive, in Council District 10, as requested by Equity Ventures Commercial Development, L.C., for a fee of $11,800.00.
