SUBJECT:

Professional Services Agreement for City of San Antonio, Development Services Department (DSD), to provide Owner-Requested Construction Document Review and Construction Inspections for Microsoft Corporation data center located in Bexar and Medina Counties, which is outside the City’s jurisdiction and authorizing five positions in the Development Services Fund.

SUMMARY:

This Ordinance authorizes the City of San Antonio Development Services Department to provide and facilitate the professional services of Document Reviews and Construction Inspections at the Microsoft data center, located in Bexar and Medina Counties, which is outside the City’s jurisdiction for enforcement of building codes.

BACKGROUND INFORMATION:

Microsoft Corporation is building a new data center, located in Bexar and Medina Counties, which is outside the City’s jurisdiction. While the new facility is not required to adhere to the City’s adopted building codes, Microsoft requested that DSD provide professional services of Document Reviews and Construction Inspections to document the extent of compliance with City building codes at its new facility.

While under this Agreement, the City will serve as a provider of professional services only and will not issue any official construction permits or occupancy certificates; however, the City of San Antonio will be entitled to the same privileges and protections as a governmental authority as provided under Chapter 1 of the International Building Code and relevant equivalent sections of other applicable codes.

As a result of this agreement, five positions will be authorized in the Development Services fund and dedicated to this project to ensure plan review and inspections are completed in a timely manner. Once the Microsoft project is completed, the positions will be evaluated to ensure that the positions are needed.

ISSUE:

Microsoft’s data center is located outside the City’s jurisdiction and is not required to adhere to the City of San Antonio’s policies and regulations regarding building codes and construction standards. Development Services is requesting additional staffing to be dedicated to the project in the amount of five positions.

ALTERNATIVES:

The alternative is to not enter into the agreement with Microsoft and to not perform the Document Reviews and Construction Inspections at its facility outside the City’s jurisdiction.

FISCAL IMPACT:

The ordinance authorizes a Professional Services Agreement for City of San Antonio, Development Services Department (DSD), to provide Owner-Requested Construction Document Review and Construction Inspections for Microsoft Corporation data center located in Bexar and Medina Counties.  Revenues generated from this agreement in the amount of $464,000 will be deposited in the Development Services Fund and will be used to offset expenses associated with adding five positions that will be dedicated to this project.

RECOMMENDATION:

Staff recommends authorizing the professional services agreement with Microsoft Corporation and increasing Development Services staffing levels.
