SUBJECT:
Disposition: Closure of an alley portion Public Right of Way located between 421 and 425 Brees Boulevard
SUMMARY:
An ordinance closing, vacating and abandoning 0.041 acres of an alley portion Public Right of Way, located between 421 and 425 Brees Boulevard, in Council District 10, as requested by Amanda and Holland Lawrence, for a fee of $10,688.00.
BACKGROUND INFORMATION:
Amanda and Holland Lawrence (Petitioners living at 421 Brees) are requesting the closure, vacation and abandonment of an alley portion Public Right of Way, located between 421 and 425 Brees Boulevard as shown on attached Exhibit A. The abutting property owners on either side of the subject alley have agreed to the proposed closure and if approved, the Petitioners would like to enclose their portion of the alley for use as additional yard space.
Amanda and Holland Lawrence will share responsibility of the alley with the residents at 425 Brees. Both property owners are legally entitled to a proportionate share of the alley and this will be recorded in the ordinance and filed appropriately.
ISSUE:
This ordinance will close, vacate and abandon 0.041 acres of an alley portion Public Right of Way, located between 421 and 425 Brees Boulevard, in Council District 10, as requested by Amanda and Holland Lawrence, for a fee of $10,688.00.
Petitioners are requesting the closure, vacation and abandonment of an alley portion Public Right of Way, located between 421 and 425 Brees Boulevard as shown on attached Exhibit A. The abutting property owners on either side of the subject alley have agreed to the proposed closure and if approved, the Petitioners would like to enclose the subject alley for use as additional yard space.
This action is consistent with City Code and Ordinances, which require Planning Commission approval for the sale or disposition of City-owned or controlled real property. The Planning Commission approved this request at its regular meeting of July 27, 2016.
ALTERNATIVES:
City Council could choose not to approve this request; however, doing so would continue the City’s obligation for maintenance.
FISCAL IMPACT:
The property value was assessed at $10,688.00, utilizing Bexar Appraisal District assessed land values as provided by Chapter 37, Section 2(g)(2) of the City Code. This revenue will be deposited into the General Fund in accordance with the FY 2016 Adopted Budget.
Also, the property will be placed on the tax rolls, generating revenue for the City of San Antonio and other taxing entities.
RECOMMENDATION:
Staff recommends approval of this request to close, vacate and abandon an alley portion Public Right of Way, in Council District 10.
The City of San Antonio’s Planning Commission approved this request at its regular meeting of July 27, 2016.
