SUBJECT:   Inter-local Agreement between the City of San Antonio “COSA” and the City of Olmos Park

 

 

 

SUMMARY:

 

An Ordinance approving an Inter-local Agreement between the City of San Antonio “COSA” and the City of Olmos Park.  The intent of this City-City Inter-local Agreement is to authorize the City of Olmos Park for the enforcement of its subdivision regulations and its Building Code Ordinance. 

 

 

BACKGROUND INFORMATION:

 

Olmos Park has duly identified properties in its city limits that are in both Olmos Park and COSA city limits hereinafter referred to as “Identified Properties” (EXHIBIT A).  The Texas Government Code, Chapter 791, authorizes COSA and Olmos Park to enter into an Inter-local Contract regarding the provision of Governmental Functions and Services.  The intent of this City-City Inter-local Agreement is to authorize the City of Olmos Park for the enforcement of its subdivision regulations and its Building Code Ordinance.  COSA shall be a certifying agency regarding platting; Olmos Park shall allow COSA inspectors access to any improvement to any of the Identified Properties; and COSA may request that Olmos Park halt construction if the applicable standards are not being met.

 

 

ISSUE:

 

With the properties being located within both jurisdictions, staff needs clear direction on which City is responsible for any health and safety issues. 

 

 

 

ALTERNATIVES:

 

Council could decide not to approve the Inter-local Agreement.

 

 

FISCAL IMPACT:

 

The City of Olmos Park would collect any revenue from the platting and building permits and would incur the cost of personnel for the reviewing of plats and inspection of project.

 

 

RECOMMENDATION:

 

Staff recommends Approval.
