SUBJECT: Contract Award: School Pedestrian Infrastructure Improvements

 

SUMMARY:

This ordinance for the School Pedestrian Infrastructure Improvements Project, a LAM funded Project, located in Council District 2 and 3, accepts the lowest responsive bid and awards a construction contract in the amount of $1,907,357.85, authorized payable to Allbrite Constructors of Texas LLC, of which $115,303.50 will be reimbursed by San Antonio Water Systems (SAWS), and $1,565,975.00 will be reimbursed by Texas Department of Transportation (TxDOT).  

BACKGROUND INFORMATION:

In an effort to increase the safety of pedestrians near and around schools and transportation sites, the City submitted for funding to the Alamo Area Metropolitan Planning Organization (AAMPO) for infrastructure improvements.  Five projects were submitted that supported the Transportation Alternatives Program (TAP) intention to promote non-motorized transportation as an integral part of the overall transportation system. The School Pedestrian Improvements Project was selected by the AAMPO to be funded. The City executed an Advanced Funding Agreement with the TxDOT accepting reimbursement in the amount of $1,565,975.00 for construction related expenses.

 

This Project provides for the construction of sidewalk improvements near Poe Middle School, Connell Middle School, Charles Ball Elementary School, Douglass Middle School and Herff Elementary School, all located in the San Antonio Independent School District, in an effort to improve safety for school children in those areas. Construction is scheduled to begin in November 2016 and estimated to be completed in May 2017.

 

 

 

Previous Council Action:

On August 21, 2014, City Council authorized the submission of an application to the Alamo Area Metropolitan Planning Organization (AAMPO) for five (5) projects for funding consideration under the Transportation Alternatives Program through Ordinance 2014-08-21-0615.  On August 20, 2015, City Council authorized the execution of an Advanced Funding Agreement between the City of San Antonio and the Texas Department of Transportation, accepting reimbursement in an estimated amount of $1,565,975.00 from TxDOT for construction-related expenses to the School Pedestrian Infrastructure Improvements project, located in Council District 2 and Council District 3.

 

Procurement of Services

The Project was advertised for construction bids in the San Antonio Hart Beat, on the City of San Antonio’s website and the Texas Electronic State Business Daily in August 2016.  Bids for this Project were opened on August 16, 2016 and nine bidders responded. Allbrite Constructors of Texas, LLC submitted the lowest responsive bid. 

Due to the utilization of federal dollars, the Disadvantaged Business Enterprise (DBE) program of the State of Texas is utilized in place of SBEDA. This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

ISSUE:

This ordinance for the School Pedestrian Infrastructure Improvements Project, a LAM-funded Project, located in Council District 2 and 3, accepts the lowest responsive bid and awards a construction contract in the amount of $1,907,357.85, authorized payable to Allbrite Constructors of Texas LLC, of which $115,303.50 will be reimbursed by San Antonio Water Systems (SAWS), and $1,565,975.00 will be reimbursed by TxDOT.  

This Project provides for the construction of sidewalk improvements near Poe Middle School, Connell Middle School, Charles Ball Elementary School, Douglass Middle School and Herff Elementary School, all located in the San Antonio Independent School District, in an effort to improve safety for school children in those areas. Construction is scheduled to begin in November 2016 and estimated to be completed in May 2017. Construction activities will take place six days a week from sunrise to sunset.

 

ALTERNATIVES:

As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.

  

FISCAL IMPACT:

This is one-time capital improvement expenditure in the amount of $1,907,357.85, payable to Allbrite Constructors of Texas LLC, for construction of which $115,303.50 will be reimbursed by San Antonio Water Systems (SAWS), and $1,565,975.00 will be reimbursed by TxDOT and $226,079.35 will be the City’s contribution toward the required local match.

On August 20, 2015, City Council approved the Advanced Funding Agreement with the Texas Department of Transportation for the School Pedestrian Infrastructure Improvements Project through Ordinance 2015-08-20-0715.  As a Local Agency Management (LAM) project, the City must follow federal requirements to ensure reimbursement from TxDOT in the amount of $1,565,975.00 related to construction costs. 

 

RECOMMENDATION:

Staff recommends approval of this ordinance awarding a construction contract in the amount of $1,907,357.85 to, Allbrite Constructors of Texas LLC for construction, of which $115,303.50 will be reimbursed by San Antonio Water Systems (SAWS), and $1,565,975.00 will be reimbursed by TxDOT.
