SUMMARY:
Request by Frank L. Massey, S.C.A.R., Inc., for approval to vacate and resubdivide a tract of land to establish Scar Subdivision, generally located east of the intersection of Northeast Loop 410 and Perrin-Beitel Road. It is noted that the applicant has been made aware that plat approval will not preempt existing zoning restrictions.
Variance Request:
One November 1, 2016, the applicant requested a variance from 35-F124 (e) and 35-F124 (f) (20) of the Unified Development Code (UDC). Transportation & Capital Improvements, Storm Water Division has no objection to the granting of the variance as indicated in the attached report (ATTACHMENT 2).
Alternative Actions:
Per State Law, Section, 212.009 and Unified Development Code, Section 35-432(e) the Planning Commission must approve Plats that conform to the Code.
RECOMMENDATION:
Approval of a Subdivision Plat that consists of 14.800 acre tract of land, which proposes two (2) non single-family residential lots.
Staff reviewed the request, and found it to be in conformance with the Unified Development Code (UDC) with exception of the Variances mentioned above. In regards to the Variances, staff does concur with the applicant's justification. Therefore, the Director of Development Services recommends approval of the variances and plat.
