Sports License Agreement with Prospect Hill Yellow Jackets Athletic Club
SUMMARY:
This ordinance authorizes the execution of a Sports License Agreement with Prospect Hill Yellow Jackets Athletic Club for use and maintenance of three (3) sports fields and concession building at Rosedale Park located in Council District 5 for a five year term beginning January 1, 2017, and ending December 31, 2021; no City funds are associated with this action.
BACKGROUND INFORMATION:
The Prospect Hill Yellow Jackets Athletic Club (Yellow Jackets) have utilized sports fields at Rosedale Park for organized youth baseball programming since 1981, and more recently have added an organized youth football program at the park, all for the benefit of nearly 1,000 area youth each year. In lieu of rent, the Yellow Jackets have conducted annual maintenance through an Exchange of Services Agreement and have made capital improvements to the premises. The proposed long-term agreement will allow for use and maintenance of the fields for youth sports programming.
Under the terms of the proposed Sports License Agreement, the Yellow Jackets will have priority use of three (3) sports fields and concession building located at Rosedale Park, and will be permitted to operate concessions with proceeds benefiting the program. In lieu of rent, the Yellow Jackets will continue to maintain the licensed premises and construct improvements at their sole expense during the term of the Agreement.
A waiver for the Small Business Economic Development Advocacy Program (SBEDA) was issued for this contract as the application of SBEDA is infeasible since no procurement activity will result from the execution of this Sports License Agreement.
ISSUE:
This ordinance authorizes a Sports License Agreement with Prospect Hill Yellow Jackets Athletic Club for use and maintenance of three (3) sports fields and concession building at Rosedale Park for a five year term beginning January 1, 2017, and ending December 31, 2021. This action is consistent with the City policy to facilitate the use of parks for athletic and recreational activities by the citizens of San Antonio.
ALTERNATIVES:
This Sports License Agreement will allow priority use of the sports fields and concession building in return for maintenance of the fields, thus continuing the existing care arrangements. An alternative would be to require the organization to continue to reserve the fields through the reservation office; however, the City would be responsible for the maintenance of the fields which would have a corresponding budgetary impact and the organization would be subject to available scheduling dates.
FISCAL IMPACT:
There is no General Fund impact associated with this action. Under the terms of this Sports License Agreement, Prospect Hill Yellow Jackets Athletic Club will not pay rent in exchange for providing all associated maintenance and improvements, which will result in cost avoidance to the City.
RECOMMENDATION:
Staff recommends approval of the Sports License Agreement with Prospect Hill Yellow Jackets Athletic Club for use and maintenance of three (3) sports fields and concession building located at Rosedale Park.
