Amendment to Antenna License Agreement with Carlos Lopez
SUMMARY:
This ordinance authorizes amending the antenna license agreement between the City of San Antonio and Carlos Lopez to renew the agreement through February 28, 2022.
BACKGROUND INFORMATION:
Ordinance 2012-03-01-0145 authorized an antenna license agreement with Carlos Lopez to operate and maintain a radio broadcast translator and associated equipment at the Tower of the Americas. The agreement, which is set to expire on February 28, 2017, includes one five-year renewal option with City Council approval.
ISSUE:
This ordinance will authorize amending the license agreement to renew through February 28, 2022. The amendment also establishes the annual license rate for the renewal period. Approval of this ordinance is consistent with the City’s policy of licensing public facilities for commercial purposes.
ALTERNATIVES:
The City may elect not to amend and renew the agreement, which would result in the licensee’s occupancy becoming at will or terminating.
FISCAL IMPACT:
The amendment requires the licensee pay a fee of $25,842.11 in Year 1 of the renewal period, with an annual increase of 3.00% thereafter. All revenue received from the amendment will be deposited into the General Fund.
RECOMMENDATION:
Staff recommends approval of amending the License Agreement between the City of San Antonio and Carlos Lopez to renew the agreement through February 28, 2022.
