SUBJECT: First Amendment and Extension to First Amended and Restated Baseball Stadium Facility Lease Agreement with the San Antonio Missions Baseball Club, Inc.
SUMMARY:
This Ordinance authorizes a First Amendment and Extension to First Amended and Restated Baseball Stadium Facility Lease Agreement with the San Antonio Missions Baseball Club, Inc. through September 30, 2021.
BACKGROUND INFORMATION:
Ordinance Number 2006-11-16-1300, dated November 16, 2006, authorized the Baseball Stadium Facility Lease Agreement with the San Antonio Missions Baseball Club, Inc. The original lease was for an initial term of ten (10) years with three (3) additional five (5) year renewal options. The term effectively commenced November 26, 2006, and expired September 30, 2016.
The City and San Antonio Missions Baseball Club, Inc. have negotiated and agreed to exercise the First Term Option and extension to the Agreement through September 30, 2021 and amend the provisions of the Agreement below with the goal of making Wolff Stadium first in class in order to enhance the customer experience:
* No later than September 30, 2018, the Parties shall develop a mutually agreed upon plan for improvements made to the Stadium and cost for these improvements shall be split between the City and Lessee, with Lessee responsibility for 30% of costs and City responsible for 70% of costs to be paid from facility access fees, subject to future City Council budgetary appropriation;
* The Stadium Improvements Plan shall be implemented no later than September 30, 2019 and the improvements shall become property of City upon termination of this Agreement;
* Lessee shall implement maintenance staffing in order to achieve a 'best in Texas League' standard.
