Disposition: Closure of an unimproved alley portion Public Right of Way located adjacent to 205 West Harlan Avenue


SUMMARY:

A resolution supporting the closure, vacation and abandonment of 0.096 of an acre of an unimproved alley Public Right of Way, located adjacent to 205 West Harlan Avenue, in Council District 3, as requested by Roland Huerta, for a fee of $4,810.00.


BACKGROUND INFORMATION:

Roland Huerta, Petitioner, is requesting the closure, vacation and abandonment of an unimproved alley (4,175 square feet) Public Right of Way as shown on attached Exhibit A. Petitioner does not have a driveway on his property; therefore, if the proposed closure is approved, would like to add the proposed closure to his home for the construction and use of a driveway. All abutting property owners have consented to the abandonment.


ISSUE:

This resolution will support the closure, vacation and abandonment of 0.096 of an acre of an unimproved alley Public Right of Way, located adjacent to 205 West Harlan Avenue, in Council District 3, as requested by Roland Huerta, for a fee of $4,810.00.

This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property.


ALTERNATIVES:

Planning Commission could choose not to approve this request; however, if not approved, the right-of-way will remain underutilized.
