SUBJECT:

 

Brooks Development Authority: Funding Agreement for the South New Braunfels Extension Project and Funding Agreement Amendment for Brooks Drainage & Multi-Use Pathway Project

 

 

SUMMARY:

 

Consideration of the following items related to infrastructure improvements at Brooks City Base, located in Council District 3:

 

A.                     An ordinance authorizing the execution of a Funding Agreement with Brooks Development Authority (BDA) for South New Braunfels extension from Lyster Road to Loop 410 South Project in the amount of $2,000,000.00 funded with Certificates of Obligation as approved in the FY 2017 Budget.

 

B.                     An ordinance authorizing an amendment to a Funding Agreement with Brooks Development Authority (BDA) for Brooks Drainage and Multi-Use Pathway Project to allow the project to be completed in its entirety rather than in segments and amending the completion date from March 2016 to February 2018.  

                     

 

BACKGROUND INFORMATION:

 

 

A.                     The South New Braunfels from Lyster Road to Loop 410 Project is intended to provide a much needed alternative to the existing street system surrounding Brooks City Base (Southeast Military Drive, South Presa Street, and Goliad Road) as well as provide easier access to IH-37 and Loop 410 South. The improvements will allow for efficient traffic movement, less congestion and facilitate the development of the Brooks City Base campus. This project will provide necessary design, engineering, right-of-way planning and acquisition from Lyster Road to Loop 410 South.  The S. New Braunfels project will consist of preliminary design and engineering for an 86 foot right-of-way including signalized intersections, storm drains, drainage channel excavation, storm water detention systems, a 10-foot wide multi-use path, utilities, landscaping and irrigation.    

 

This agreement will be executed in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 20% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 2% African American Business Enterprise (M/WBE) subcontracting goal. Brooks Development Authority has committed to 20% M/WBE and 2% AABE subcontractor participation. 

 

B.                     Brooks Drainage and Multi-use Pathways Project will transform approximatley 43-acres of under-utilized floodplain and drainage channels between S.E. Military Drive and Old Corpus Christi Road into a linear park with ponds, pavillions, lighted walking and biking paths, recreation areas, restroom facilities, parking, public art, and Wi-Fi connectivity.  Project was origionally to be delivered in phases, but will now be completed as one project.  Construction started August 2016 and is estimated for completion in Winter 2018.

 

Previous Council Action:

The Brooks Drainage and Multi-use Pathways Project was approved by City Council on September 12, 2013 through the City’s FY 2014 Adopted Budget through Ordinance  2013-09-12-0628.

 

 

ISSUE:

 

Consideration of the following items related to infrastructure improvements at Brooks City Base, located in Council District 3:

 

A.                     This ordinance authorizes the execution of a Funding Agreement with Brooks Development Authority (BDA) for South New Braunfels extension from Lyster Road to Loop 410 South Project in the amount of $2,000,000.00 funded with Certificates of Obligation for preliminary design and engineering, as approved in the FY 2017 Budget.

 

The South New Braunfels extension from Lyster Road to Loop 410 South Project will consist of preliminary design and engineering for an 86 foot right-of-way including signalized intersections, storm drains, drainage channel excavation, storm water detention systems, a 10-foot multi-use path, utilities, landscaping and irrigation. 

 

B.                     This ordinance authorizes an amendment to a Funding Agreement with Brooks Development Authority (BDA) for Brooks Drainage and Multi-Use Pathway Project to allow the project to be completed in its entirety and amend the completion date from March 2016 to February 2018.   

 

The Brooks Drainage and Multi-Use Pathway Project was originally intended to be constructed in phases. However, Brooks Development Authority would like to move forward with a project that allows the scope to be completed in its entirety and with an adjusted project schedule.

 

 

ALTERNATIVES:

 

The City Council could choose not to approve these agreements; however, doing so would delay the City from moving forward with its commitment to provide $2 million in funding for public infrastructure improvements at Brooks City Base for the South New Braunfels project and eliminate the various phases and use of funds to complete the project.

 

 

FISCAL IMPACT:

 

A.                     This is one-time capital improvement expenditure in the amount of $2,000,000.00 payable to Brooks Development Authority. Funds are available from Certificates of Obligation for infrastructure improvements at Brooks City-Base,  and included in the FY 2017-2022 Capital Improvements Program.

 

B.                     Funding for the Brooks Drainage and Multi-Use Pathway Project was previously approved through the City’s FY 2014 Adopted Budget for which City Council authorized $3,000,000.00 payable to Brooks Development Authority through Ordinance 2013-09-12-0268. This Council action does not impact the project funding but rather allows the project to be completed in its entirety and with an adjusted project schedule.

 

 

RECOMMENDATION:

 

Staff recommends approval of the following items related to infrastructure improvements at Brooks City Base, located in Council District 3:

 

A. An ordinance authorizing the execution of a Funding Agreement with Brooks Development Authority (BDA) for South New Braunfels extension from Lyster Road to Loop 410 South Project in the amount of $2,000,000.00 in Certificates of Obligation.

 

B.                     An ordinance authorizing an amendment to a Funding Agreement with Brooks Development Authority (BDA) for Brooks Drainage and Multi-Use Pathway Project to allow the project to be completed in its entirety and amend the completion date.
