Change Order:  Theo and Malone Corridors

 

SUMMARY:

 

An ordinance authorizing a change order for the Theo Avenue and Malone Corridor Improvements Project, a 2012-2017 Bond funded project, in the amount of $282,394.88 and authorizing payment to Capital Excavation Company for curbs, sidewalks, driveway approaches and pavement restoration at the intersecting streets between Theo Avenue and Malone Avenue located in Council District 5.

 

BACKGROUND INFORMATION:

 

The 2012-2017 General Obligation Bond Program authorized $14,195,000.00 for the Theo Avenue & Malone Avenue Corridors Project. On February 12, 2015, City Council authorized a construction award in the amount of $15,095,329.00 to Capital Excavation and of this amount $4,788,426.00 to be reimbursed by San Antonio Water Systems (SAWS) and $1,029,145.00 to be reimbursed by CPS Energy.

 

This Project provided for the reconstruction of approximately 1.25 miles of the one-way street Theo Avenue and 1.25 miles of the one-way street Malone Avenue from IH-35 to Zarzamora, including two 11-foot travel lanes, an 8-foot parking lane, a 5 foot bicycle lane, 4-foot sidewalks, curbs, driveway approaches and drainage improvements throughout the project limits.  Traffic signal upgrades were included at the intersections of Nogalitos and Theo Avenue and Nogalitos and Malone Avenue. A community meeting was held on April 25, 2013 at the Palm Heights Park Community Center.

 

Project construction began in February 2015 and is currently in the final stages of construction with estimated completion in late June 2017.

 

Previous Council Action

A previously executed contract with Capital Excavation Company for the Theo and Malone Corridor Project, in the amount of $15,095,329.00, was approved by City Council on February 12, 2015 through Ordinance 2015-02-12-0085. A table of the subsequent change orders is shown below.

This contract will continue to comply with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts to be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set the Minority and/or Women-Owned Business Enterprise (M/WBE) subcontracting goal to 13% and the Small Business Enterprise (SBE) subcontracting goal to 22%.

 

ISSUE:

 

This ordinance authorizes a change order for the Theo Avenue and Malone Corridor Improvements Project; a 2012-2017 Bond funded project in the amount of $282,394.88 and authorizes payment to Capital Excavation Company for improvements to the intersecting streets between Theo Avenue and Malone Avenue, located in Council District 5.

 

These areas will be improved now rather than waiting to be programmed into future Infrastructure Management Program projects.

 

The change order, requested by the City, authorizes payment in the amount of $282,394.88 for curbs, sidewalks, driveway approaches and pavement restoration on the following cross streets: Phyllis St., Charlotte St., De Soto St., Gladys St., Adina St., Buffalo St., Carnot St., Collingsworth Ave., and Frelon St.  The curbs, sidewalks, driveway approaches will enhance mobility, and promote neighborhood connectivity for pedestrians traveling to and around transit corridors, nearby retailers, St. James Catholic School, Palm Heights Christian Academy and the Palm Heights Center. Since FY 2014 the City has increased sidewalk funding surrounding schools and these improvements allow the City to continue the commitment to filling in sidewalk gaps where they exist. Incorporating the sidewalk improvements as part of the Theo and Malone Corridors Project allows the City to make the investment in the neighborhood’s infrastructure while crews are mobilized, pricing is favorable, and funds are available.

 

The project is estimated for completion in late July 2017.  

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to approve the change order thereby requiring staff to procure a new solicitation for the work.  However, this may lead to further delays of the final completion of the project and it is likely to cause an increase in price.  The most cost effective option is to approve this change order.

 

FISCAL IMPACT:

 

This is one-time capital improvement expenditure in the amount of $282,394.88 payable to Capital Excavation Company for construction services. Funds are available from the 2012-2017 General Obligation Bond Program for the Theo and Malone Corridor Project and are included in the FY 2017-2022 Capital Improvement Budget. 

 

 

RECOMMENDATION:

 

Staff recommends approval of the City requested change order in the total amount of $282,394.88 for the Theo and Malone Corridor Project.
