Change Order: 36th Street Phase IIIB (Billy Mitchell to General Hudnell): Sanitary Sewer Crossing

 

 

SUMMARY:

 

An ordinance for the 36th Street Phase IIIB: Billy Mitchell to General Hudnell Project, a 2012-2017 General Obligation Bond and federally funded project, authorizing a change order in the increased amount of $139,515.00 payable to Shannon Monk for sanitary sewer work, located in Council District 4.

 

 

BACKGROUND INFORMATION:

 

On May 12, 2012, voters approved the 2012-2017 General Obligation Bond Program which provided $6 million towards the improvements of 36th Street. This project provides for the reconstruction of the roadway along 36th Street from Billy Mitchell to General Hudnell to include curbs, sidewalks, a shared use path and a drainage channel. Project construction began in August 2015 and is estimated to be completed by September 2017.

 

On April 13, 2017, City Council approved Ordinance 2017-04-13-0243 to authorize a funding agreement with Port Authority of San Antonio (Port SA) for a capital project in an amount not to exceed $1,539,960.00.  The funding agreement was a part of a comprehensive plan to support Port SA’s economic development project, known as Project Tech. 

 

Within the funding agreement, capital improvement funds were allocated for specific site development items, including the extension of major utility lines.  One of these major utilities is a 15-inch diameter sanitary sewer line, which crosses 36th Street within the limits of the 36th Street Phase IIIB project.  Port San Antonio and City staff determined that it would benefit both projects if the sanitary sewer work was completed in advance by the 36th Street Phase IIIB contractor, Shannon Monk. 

 

Previous Council Action

A previously executed contract with Shannon Monk for the 36th Street Phase IIIB project, from Billy Mitchell to General Hudnell, for $8,078,660.90 was approved by City Council on June 6, 2015, through Ordinance 2015-06-04-0481.  Previous Change orders have increased this contract by $774,748.56. This change order will increase the contract by $139,515.00 to a contract amount of $8,992,924.46.

 

 

ISSUE:

 

This ordinance for the 36th Street Phase IIIB: Billy Mitchell to General Hudnell Project, a 2012-2017 General Obligation Bond and federally funded project, authorizing a change order in the increased amount of $139,515.00 payable to Shannon Monk for sanitary sewer work, located in Council District 4.

 

As part of the development of the Project Tech building, this change order allows the 36th Street contractor, Shannon Monk, to install the sanitary sewer line for Project Tech while the 36th Street Project is still under construction.  Allowing Shannon Monk to construct the sanitary sewer line is the most beneficial option. Otherwise, portions of the newly constructed 36th Street pavement will be demolished by future installation of the required sanitary sewer line.  Due to Right of Way Division regulations, the project would be required to mill and overlay the full block of 36th Street to restore the pavement to original condition.  This is a costly option and after discussions with Port SA, City staff and Port SA staff agree it would be better to install the sanitary sewer line prior to the final asphalt being placed through the 36th Street Phase IIIB Project.  

 

This plan revision will not be reimbursed by TxDOT and Federal Highway Administration (FHWA).  The $139,515.00 will be funded from Port SA Site Development Project funds (also known as Project Tech).

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to approve this change order to fund the sanitary sewer improvements from Project Tech however doing so would require future demolition of the newly improved 36th Street The most cost effective option is to move forward with the proposed change order.

 

 

FISCAL IMPACT:

 

This is a one-time capital expenditure in the amount of $139,515.00 for the 36th Street Phase IIIB: Billy Mitchell to General Hudnell Project, made payable to Shannon Monk, available from 2017 Certificates of Obligation included in the FY 2017-2022 Capital Improvement Budget from the Port SA Site Development Project, otherwise known as Project Tech.

 

 

RECOMMENDATION:

 

Staff recommends approving this change order, in the amount of $139,515.00, for the 36th Street Phase IIIB: Billy Mitchell to General Hudnell Project.
