Disposition: Closure of an improved portion of Britney Circle Public Right of Way located between O’Connor Road and dead-ending into NCB 15911
SUMMARY:
A resolution supporting the closure, vacation and abandonment of an improved 0.6562 of an acre of Britney Circle Public Right of Way, located between O’Connor Road and dead-ending into NCB 15911, in Council District 10, as requested by Rockport Family Partnership, Ltd., for a fee of $21,500.00.
BACKGROUND INFORMATION:
Rockport Family Partnership, Ltd., Petitioner, is requesting the closure, vacation and abandonment of an improved 0.6562 acre portion (28,586 square feet) of Britney Circle Public Right of Way as shown on attached Exhibit A. If approved, closure would facilitate the development of the Petitioner’s abutting property for the construction of a boat and RV storage facility. Petitioner is the sole abutting property owner.
ISSUE:
This resolution will support closure, vacation and abandonment of an improved 0.6562 of an acre of Britney Circle Public Right of Way, located between O’Connor Road and dead-ending into NCB 15911, in Council District 10, as requested by Rockport Family Partnership, Ltd., for a fee of $21,500.00.
Rockport Family Partnership, Ltd., Petitioner, is requesting the closure, vacation and abandonment of an improved 0.6562 acre portion (28,586 square feet) of Britney Circle Public Right of Way as shown on attached Exhibit A. If approved, closure would facilitate the development of the Petitioner’s abutting property for the construction of a boat and RV storage facility. Petitioner is the sole abutting property owner.
This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property.
ALTERNATIVES:
Planning Commission could choose not to approve this request; however, if not approved, the right-of-way will remain underutilized.
FISCAL IMPACT:
The fair market value of the Right of Way is $21,450.00, which was established by an appraisal performed by Noble and Associates, Inc. on November 30, 2016. With added administrative costs, the City will collect a total of $21,500.00 for this property. This revenue will be deposited into the General Fund in accordance with FY 2017 Adopted Budget.
Also, the property will be placed on the tax rolls, generating revenue for the City of San Antonio and other taxing entities.
RECOMMENDATION:
Staff recommends approval of this request to close, vacate and abandon an improved portion of Britney Circle Public Right of Way, in Council District 10.
