SUBJECT:

Execution of Amendment No. 2 to the Caretaker Lease Agreement with Dale Chumbley at Phil Hardberger Park


SUMMARY:

This ordinance authorizes execution of Amendment No. 2 to the Caretaker Lease Agreement with Dale Chumbley at Phil Hardberger Park, located in Council District 8.


BACKGROUND INFORMATION:

In 2007, a Caretaker Lease Agreement was authorized with Dale Chumbley for portions of Phil Hardberger Park, and was renewed through September 30, 2017. The City requests to retain the services of the live-in caretaker through September 30, 2019, and include two, one-year extensions. Under the terms of the agreement, the caretaker shall continue to reside at the 1924 Voelcker farmhouse in order to monitor leased area which has limited visibility from park proper. Additionally, the caretaker is responsible for paying all utilities and $100.00 in monthly rent while maintaining the leased premises (approximately 1.01 acres).


ISSUE:

This ordinance authorizes an Amendment to extend the term for the Phil Hardberger Park Caretaker Lease Agreement through September 30, 2019.


ALTERNATIVES:

Maintaining Caretaker services at Phil Hardberger Park through this Agreement will allow the Parks and Recreation Department to focus resources toward planned development of other areas of the Park, as outlined in the Park's Master Plan. An alternative is to allow the current Caretaker's Lease Agreement to lapse, wherein the City would assume responsibility of all on-going maintenance, repairs and monitoring of this portion of the Park, resulting in an increase in costs to the General Fund.


FISCAL IMPACT:

There is no fiscal impact to the General Fund. The Caretaker will be responsible for payment of utilities, general maintenance of the 1924 Voelcker farmhouse and surrounding yard, general inspection and maintenance of perimeter fencing...
