SUBJECT: Revisions to Chapter 19 of the City Code

 

 

SUMMARY:

 

Ordinance amending Chapter 19 of the City Code to update the Traffic Control Devices Schedules to add locations where new installations of traffic control devices have occurred, remove locations where devices have been altered or removed, and update oversized vehicle parking violations.

 

 

BACKGROUND INFORMATION:

 

This ordinance will revise Sections 19-68(b), 19-38, and 19-225(h) of the City Code.

 

                     Section 19-68(b) provides a schedule of Traffic Control Devices by type and location.  In order to have effective enforcement, all traffic control devices need to be present on these schedules.  Types of traffic control devices include, but are not limited to, stop signs, traffic signals, parking restrictions and speed limit designations.  Approval of this ordinance will enable consistent enforcement of on-street traffic regulations and is a continuation of City Council policy to maintain efficient and safe traffic flow.  The last Traffic Control Devices schedule update was on April 6, 2017.

 

                     Section 19-38 provides a schedule of fines for parking violations.  This ordinance will update Oversized Vehicle violation amounts established in Section 19-38(21) of the City Code of Ordinances.  Additionally, the requirement to post signage prohibiting oversized vehicles parking is being removed to reduce the amount of sign clutter within residential zones. 

 

                     Section 19-225 provides administrative adjudication of stopping, standing and parking violations.  This ordinance will update Section 19-225(h) to amend the definition of “Maximum Fine”.

 

ISSUE:

 

This ordinance amends Chapter 19 of the City Code to update the Traffic Control Devices Schedules to add locations where new installations of traffic control devices have occurred, remove locations where devices have been altered or removed, and update oversized vehicle parking violations.

 

Traffic Control Devices Schedules:

Approval of this ordinance amending Section 19-68(b) will enable consistent enforcement of on-street traffic regulations and is a continuation of City Council policy to maintain efficient and safe traffic flow.  These schedules are updated to reflect new traffic control device installations and/or removal of such devices at specified locations. These device installations and/or removals are a result of traffic engineering evaluations which are typically prompted by citizen requests. The following traffic control devices were added (included) since the previously enacted traffic code update on April 6, 2017.

 

1.                     Full Traffic Signal Locations - (3 additional locations) [Schedule A(a) -  update]

2.                     All Way Stops - (2 additional locations) [Schedule C(a) - update]

3.                     Cross Street Stop - (35 additional locations) [Schedule C(b) - update]

4.                     Maximum Speed Limit - (4 additional locations) [Schedule E(a) - update]

5.                     Parking Prohibited At All Times, Including Sundays And Holidays - (30 additional locations) [Schedule G(a) - update]

6.                     Stopping, Standing, Or Parking Prohibited 7 AM to 9 PM - (1 additional location) [Schedule H(a) - update]

7.                     Stopping, Standing, Or Parking Prohibited 7 AM to 9 AM and 2 PM to 4 PM School Days Only - (4 additional locations) [Schedule H(i) - update]

8.                     Stopping, Standing, Or Parking Prohibited 7 AM to 9 AM and 2 PM to 5 PM School Days Only - (3 additional locations) [Schedule H(k) - update]

Oversized Vehicles:

Approval of this ordinance amending Sections 19-38 and 19-225(h) will enable the City to effectively respond to the increased amount of violations of oversized vehicles parking within residential zones.  The violation amount is being increased from $35.00 to $500.00.  Additionally, the requirement to post signage prohibiting oversized vehicles parking is being removed to reduce the amount of sign clutter within residential zones. 

 

                     The definition of “Maximum Fine” is being amended as follows: Maximum fine. The total fine of fines, costs, and fees per violation shall not exceed five hundred dollars ($500.00).  All fines, costs, and fees shall be paid into the city treasury general fund for the use and benefit of the city.

 

                     Chapter 19, Section 38 will be updated in accordance with the table below.

ALTERNATIVES:

 

City Council could choose not to approve this item; however, this would limit the City’s ability to enforce the traffic control devices at the locations listed in the attachment, and also minimize the City’s effectiveness in deterring oversized vehicle parking in residential zones.

 

 

FISCAL IMPACT:

 

There is no fiscal impact associated with this ordinance.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance to amend Chapter 19 of the City Code to update the Traffic Control Devices Schedules to add locations where new installations of traffic control devices have occurred, remove locations where devices have been altered or removed, and update oversized vehicle parking violations.
