Real Estate Disposition: Request the release of a City drainage easement
SUMMARY:
An ordinance authorizing the release of a City of San Antonio-Storm Water released drainage easement being 0.492 of an acre, located in New City Block 15688 near the intersection of Higgins Road and Stahl Road, in Council District 10, as requested by ACL Creek Ventures LLC.
BACKGROUND INFORMATION:
ACL Creek Ventures LLC, Petitioner, is requesting that the City of San Antonio release a permanent drainage easement consisting of 0.492 acres, located off Higgins Road in the location as shown on attached Exhibit A. The subject original drainage easement (on platted Lots 14 and 15 Block 44 NCB 16958 per plat Clearcreek Unit 2 (Vol 9714 Pg 136) was created in 1994. Since then development of a drainage interceptor channel (on abutting Lot 901) was completed in the Spring of 2014 to convey storm water runoff to accommodate growth in the subject area. The release of the drainage channel easement is needed to correctly reflect the newly platted drainage interceptor channel that will be replacing the current permeant drainage easement.
The request was reviewed and approved by the Transportation & Capital Improvement’s Storm Water Division (controlling department of the drainage easement) since it was determined that drainage needs would be provided and fulfilled by the new drainage interceptor channel.
ISSUE:

The request was reviewed and approved by the Transportation & Capital Improvement’s Storm Water Division (controlling department of the drainage easement) since it was determined that drainage needs would be provided and fulfilled by the new drainage interceptor channel.
This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property. The Planning Commission will consider this request at its regular meeting of March 14, 2018.
ALTERNATIVES:
City Council could choose not to approve this request; however, doing so would impede the development of the property.
FISCAL IMPACT:
In compliance with Chapter 37, Section 14 of the City Code, pertaining to the release of an easement on non-City owned property, there is no fee that is charged for these types of requests.
RECOMMENDATION:
Staff recommends approval of this ordinance authorizing the release of a City drainage easement being 0.492 of an acre located in New City Block 15688 near intersection of Higgins Road and Stahl Road, in Council District 10.
The City of San Antonio's Planning Commission will consider this request at its regular meeting of March 14, 2018.
