SUMMARY:
Request by Donald Oroian, P.E., as owner’s agent, to appeal staffs decision of denial for the Administrative Exception / Variance Request, regarding the renovation of an existing residence located at 527 E. Huisache to add an additional 1,507 SF of building for the use of “assisted living” without improving the adjacent unpaved alley, which is intended to be utilized by the development as the primary egress. The Unified Development Code (UDC) Article V, Section 35-506(d)(9)(B) would require that if the adjacent alley were to be used for ingress or egress to what is deemed a commercial use then the alley must be improved by the developer to meet the standards of Table 506-3 “Conventional Street Design Standards”. Variance Request:
One April 23, 2018 the applicant requested a variance from Section 35-509(d) (9) of the Unified Development Code (UDC). The Development Services Department Engineering section objects to the granting of the variance as indicated in the attached report (ATTACHMENT #2).
RECOMMENDATION:
Staff reviewed the request, and found it to be not in conformance with the Unified Development Code (UDC) due to the Variance mentioned in the attached staff analysis. In regards to this Variance, staff does not concur with the applicant's justification. Therefore, the Director of Development Services recommends disapproval of the variance.
