City of San Antonio Fee In-Lieu-Of (FILO) process for Storm Water Mitigation.
SUMMARY:
Briefing on the current Fee In-Lieu-Of (FILO) process for Storm Water Mitigation.
BACKGROUND INFORMATION:
At the Community Health and Equity Committee meeting on March 6, 2018 Transportation and Capital Improvements (TCI) presented on the watershed master planning process. This presentation highlighted the processes by which the City identifies, designs, and funds storm water draining projects.
One way that storm water drainage projects are funded, that was briefly discussed, was by collecting a Fee In-Lieu-of (FILO) payment from private development. FILO was created by Ordinance in 1997, as a mitigation option for eligible private development to pay a Fee In-Lieu-of (FILO) on site detention. The money collected from the FILO fee is deposited into the Regional Storm Water Fund and used to fund and support various storm water drainage projects.

This briefing will provide an overview of the current Fee In-Lieu-Of (FILO) process for Storm Water Mitigation.
One way that storm water drainage projects are funded is by collecting a Fee In-Lieu-of (FILO) payment from private development. FILO was created by Ordinance in 1997, as a mitigation option for eligible private development to pay a Fee In-Lieu-of (FILO) on site detention. The money collected from the FILO fee is deposited into the Regional Storm Water Fund and used to fund and support various storm water drainage projects.
A development may qualify for participation in the FILO program by submitting an Adverse Impact Analysis or Storm Water Management Plan prepared by a licensed professional engineer for the proposed development. Once City staff has reviewed and concurred that the Adverse Impact Analysis or the Storm Water Management Plan shows no adverse impact up to 2,000 feet downstream of the development, the FILO can be paid. The FILO fee is based on the development type and the increase of impervious cover.
While FILO is one option, all developers shall participate in the Regional Storm Water Management Program (RSWMP) in one of three ways:
• Payment of a fee-in-lieu-of on site detention (except in mandatory detention areas and only where there is no adverse impact)
• Construction of on-site or off-site detention (typically storm water detention facilities) to mitigate increase in runoff resulting from the proposed development; or
• Construction or participation in the construction of an off-site regional storm water facility to mitigate increased storm water runoff anticipated from ultimate development of the watershed.
