SUBJECT:

Extension of Line of Duty Leave


SUMMARY:

This Ordinance would extend the line-of-duty (LOD) leave for Fire Engineer Eddie Douglas III. He was charged accrued leave from November 23, 2016 to April 12, 2017 for a work-related injury which occurred while on duty November 24, 2015. This ordinance will restore one thousand one hundred twenty-eight (1,128) hours, or forty-seven (47) shifts of personal leave. Approval of this ordinance is only within the authority of City Council. The Local Government Code, Chapter 143.073, states that after the one-year initial period of leave, the municipality's governing body may extend the line of duty illness or injury leave at full or reduced pay. This will allow the Department to consider this period line of duty leave.


BACKGROUND INFORMATION:

Fire Engineer Eddie Douglas III, was injured November 24, 2015 while lifting two air bottles and placing them back on the apparatus. The employee sustained injuries to his left shoulder, neck and lower back. The employee received conservative medical care as well as surgical intervention as a result of this injury. He was on Line of Duty leave from November 24, 2015 until November 22, 2016. He began using his own leave on November 23, 2016 to April 12, 2017. Fire Engineer Eddie Douglas III returned to duty on April 13, 2017.



ISSUE:

Fire Engineer Eddie Douglas III seeks an extension of Line of Duty leave from November 23, 2016 to April 12, 2017, for an on the job injury suffered on November 24, 2015. This extension will restore 1,128 hours, or 47 shifts, of his personal leave. Chapter 143 gives the City Council the authority to grant the extension of line-of-duty leave.
