SUBJECT:

 

Disposition: Closure of an unimproved Public Right of Way

 

SUMMARY:

 

An ordinance closing, vacating and abandoning an unimproved 100-foot wide Public Right of Way located between Medina Base Road and SW Military Drive adjacent to New City Block 15655, in Council District 4, as requested by Julio Gonzalez, Estela Gonzalez and Julio Gonzalez Jr., for a fee of $50,857.00.

 

BACKGROUND INFORMATION:

 

Julio Gonzalez, Estela Gonzalez and Julio Gonzalez Jr. (Petitioners) are requesting the closure, vacation and abandonment of an unimproved 2.842 acre (123,798 square feet) 100-foot wide Public Right of Way located between Medina Base Road and SW Military Drive, as shown on attached Exhibit “A”.  There was no opposition to the closure by City Departments or utilities during the canvassing process and all the abutting property owners have consented to the closure. If approved, Petitioners plan to assemble its abutting properties with the closure and sell the property for future development.

 

The City of San Antonio's Planning Commission recommended approval of this request at its regular meeting on May 9, 2018.

 

ISSUE:

 

This ordinance will close, vacate and abandon an unimproved 100-foot Public Right of Way, in Council District 4, as requested by Julio Gonzalez, Estela Gonzalez and Julio Gonzalez Jr., for a fee of $50,857.00.

 

Julio Gonzalez, Estela Gonzalez and Julio Gonzalez Jr., Petitioners, are requesting the closure, vacation and abandonment of an unimproved 2.842 acre (123,798 square feet) 100-foot wide Public Right of Way located between Medina Base Road and SW Military Drive, as shown on attached Exhibit “A”. If approved, Petitioners plan to assemble its abutting properties with the closure and sell the property for future development.

 

This action is consistent with City Code and Ordinances, which requires City Council approval for the sale or disposition of City-owned or controlled real property.

 

ALTERNATIVES:

 

City Council could choose not to approve this request; however, if not approved, the right-of-way will remain underutilized.

 

FISCAL IMPACT:

 

The fee established for this request is $50,857.00, which includes the assessed value of the unimproved Public Right of Way in the amount of $50,757.00 plus $100.00 for administrative costs. In compliance with Chapter 37 of the City Code, fair market value of the unimproved Public Right of Way was based upon utilizing Bexar Appraisal District assessed land values as provided by Chapter 37 of the City Code. These funds will be deposited into the General Fund in accordance with the FY 2018 Adopted Budget.

 

The property will be placed on the tax rolls, which will generate revenue for the City of San Antonio as well as other taxing entities.

 

RECOMMENDATION:

 

Staff recommends approval of this request to close, vacate and abandonment an unimproved 100-foot wide Public Right of Way, in Council District 4.

 

The City of San Antonio's Planning Commission recommended approval of this request at its regular meeting on May 9, 2018.
