SUBJECT:

 

Panther Springs Creek Restoration Project

 

 

SUMMARY:

 

An ordinance authorizing the execution of a task order in accordance with the existing Interlocal Agreement (ILA) between the City of San Antonio (City) and the San Antonio River Authority (SARA) for design and construction services related to the Panther Springs Creek Restoration Project for a total amount not-to-exceed $1,100,000.00 reimbursable to SARA, located in Council District 9. 

 

BACKGROUND INFORMATION:

 

On May 6, 2017, voters approved the 2017-2022 Bond Program which authorized $1,100,000.00 for the design and construction of the Panther Springs Creek Restoration. 

 

This project will improve the existing natural channel to increase flow and alleviate excessive ponding and mosquito infestation that occurs on Panther Springs Creek behind the Gardens at Greystone neighborhood after rain events.  The entire stream stretch behind the neighborhood is approximately 2,240 linear feet. 

 

Panther Springs Creek is an unimproved natural creek which is subject to local, state and federal regulations.  These regulations require discharge, floodplain and environmental habitat permits in order to finalize design.  The completion of a drainage channel restoration project takes approximately 18 to 24 months to complete the survey, design, environmental, rights of way acquisition, permitting, bidding, and construction.  The project duration is dependent on the approval and retrieval of the required applicable permits from Texas Commission on Environmental Quality (TCEQ),  US Army Corps of Engineers, Federal Emergency Management Agency (FEMA) and the Environmental Protection Agency (EPA).  Design for the Panther Springs Creek project is anticipated to be completed in November 2019.  Project construction is anticipated to begin in mid-November 2019 and is estimated for completion in May 2020.

 

Previous Council Action

An ILA between City and SARA was approved by City Council on March 12, 2015, through Ordinance No. 2015-03-12-0202, to establish and promote cooperative and collaborative development, management, and operation of storm water related programs, to improve the management of public funding sources, and ensure coordination of governmental resources and functions.  This Agreement also described roles and responsibilities between City and SARA, and established procedures to allocate specific funding to support programs, projects, and activities.  To date, ten task orders have been authorized in accordance with this ILA.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 20% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 1% African American Business Enterprise (AABE) subcontracting goal for the Panther Springs Creek Restoration Project. SARA has committed to meeting these goals.

 

ISSUE:

 

This ordinance authorizes a task order for the Panther Springs Creek Restoration Project; a 2017-2022 Bond funded project in the amount not-to-exceed $1,100,000.00 and authorizes payment to SARA for design and construction services related to the project, located in Council District 9.

ALTERNATIVES:

 

An alternative is that City Council could not approve the task order.  However, City would lose the partnership opportunity with SARA which has the knowledge and experience to manage this creek restoration project.

 

FISCAL IMPACT:

 

This ordinance authorizes a task order payment to SARA in a total amount not-to-exceed $1,100,000.00 for design and construction services related to the Panther Springs Creek Restoration Project.  Funds are available from the 2017-2022 General Obligation Bond Program and are included in the 2018-2023 Capital Improvement Program Budget.

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance authorizing the execution of a task order in accordance with the existing ILA between City and SARA for a total amount not-to-exceed $1,100,000.00 for design and construction services related to the Panther Springs Creek Restoration Project.
