SUBJECT:
Resolution supporting the acquisition of street right of way known as a section of Brooklyn Avenue between Burnet Street and Live Oak Street for jurisdiction, maintenance, and control by the City of San Antonio.
SUMMARY:
A resolution supporting the acquisition and acceptance of street right of way known as Brooklyn Avenue, between Burnet Street and Live Oak Street for the City of San Antonio's jurisdiction, control, and maintenance. This item requires City Council to initiate a motion to authorize acceptance of this right of way.
The property is being transferred to the City of San Antonio and payment for the property is being waived under the Texas Transportation Code 202.021(e), in which the City of San Antonio will assume jurisdiction, control and maintenance of the right-of-way for public road purposes.
BACKGROUND INFORMATION:
StrEat Park, LLC, in conjunction with Civil Engineer Consultants are working on a project to develop adjacent property which will require encroachment onto the City right-of-way. TXDoT does not authorize this type of encroachments onto right-of-way. TXDoT has identified this section of roadway as surplus and has agreed to transfer ownership to the City of San Antonio. The City of San Antonio has the authorization to allow encroachments onto City right-of-way.
ISSUE:
A resolution supporting the acquisition of street right of way known as a section of Brooklyn Avenue between Burnet Street and Live Oak Street for jurisdiction, maintenance, and control by the City of San Antonio.
ALTERNATIVES:
City Council could choose not to approve the request and require StrEat Park, LLC to redesign or terminate the project, increasing costs and resulting in project delays.
