Discussion and Possible Action to Approve the Memorandum of Understanding (MOU) between the City of San Antonio, Bexar County and Bandera Conservation Corridor
BACKGROUND INFORMATION:
The City of San Antonio and Bexar County, as the SEP HCP Permittees, executed an MOU with Bandera Conservation Corridor, LLC (BCC), on May 15, 2017. The MOU outlined the roles and responsibilities for the purchase by SEP HCP applicants of Golden-cheeked Warbler (GCW) credits in order to meet their mitigation requirements for the Plan.
The partnership has been a beneficial one thus far, with several Plan enrollees purchasing their GCW mitigation credits from BCC.
ISSUE:
The original MOU did not include an automatic renewal, and as such, the MOU has expired. The MOU to be considered today is essential a copy of the MOU executed in 2017, with the exception that the MOU now contains an automatic renewal of the MOU for up to two additional years after the initial one year term. This automatic renewal clause will continue to assist SEP HCP applicants with purchasing their GCW mitigation credits. The MOU retains the termination language, and the MOU can be terminated by any party, at any time, with 30 days written notice.
ALTERNATIVES:
The Coordinating Committee may choose not to move forward with executing a new MOU, but this may impact the availability of GCW mitigation credits to SEP HCP applicants.
RECOMMENDATION:
Staff recommends approval of the MOU.
