SUBJECT:

 

Disposition:  Closure of an unimproved section of Brooklyn Avenue

 

 

SUMMARY:

 

A resolution recommending the closure, vacation, and abandonment of 0.049 of an acre (7 foot wide section) being an unimproved portion of Brooklyn Avenue public right-of-way located between Live Oak Street and Burnet Street, as requested by StrEat Parks, LLC for a fee of $22,143.38.

 

 

BACKGROUND INFORMATION:

 

Petitioner (StrEat Parks, LLC) owns the adjacent tract of land at 201 Burnet Street which is separated by a 7 foot section of unimproved right-of-way and 5 foot sidewalk.  The petitioner requests the city close, vacate and abandon its interest in the subject property.  If the request is approved, petitioner can assemble and develop the properties.

 

 

ISSUE:

 

Petitioner (StrEat Parks, LLC) owns the adjacent tract of land at 201 Burnet Street which is separated by a 7 foot section of unimproved right-of-way and 5 foot sidewalk.  The petitioner requests the city close, vacate and abandon its interest in the subject property.  If the request is approved, petitioner can assemble and develop the properties.

 

The proposed closure was canvassed throughout city departments and utilities and was conditionally approved.  Per Chapter 37, notification

 

 

ALTERNATIVES:

 

The Planning Commission could choose not to recommend this request; however, if not approved, the unimproved right-of-way and surrounding properties will remain underutilized and difficult to develop.  If approved, the property will be placed on the tax rolls, and the properties can be developed.

 

 

FISCAL IMPACT:

 

There is no fiscal impact on the City of San Antonio.

 

 

RECOMMENDATION:

 

Staff recommends approval of this request to close, vacate and abandon an unimproved section of Brooklyn Avenue between Live Oak Street and Burnet Street.
