SUBJECT:  FY 2019-2020 Task Order Contracts for Flatwork and Street Improvements Packages 1 & 2

 

SUMMARY:

Consideration of the following contracts totaling $3,648,090.50 for the FY 2019 Infrastructure Management Program (IMP) and Neighborhood Access and Mobility (NAMP) Program:

 

A.                     An ordinance accepting the lowest responsive bid and awarding the 2019-2020 Task Order Contract for Flatwork and Street Improvements, Package 1 to MCOR Construction Company in an amount not to exceed $1,927,755.00, of which $113,400.00 will be reimbursed by San Antonio Water System (SAWS) for necessary adjustments to its existing infrastructure. Funds in the amount of $1,927,755.00 is included in the FY 2019 - 2024 Capital Improvements Program and funded from various funding sources to include the General Fund, Advanced Transportation District Fund, debt proceeds, or other funding sources.

Concrete, LLC in an amount not to exceed $1,720,335.50, of which $80,100.00 will be reimbursed by San Antonio Water System (SAWS) for necessary adjustments to its existing infrastructure. Funds in the amount of $1,720,335.50 is included in the FY 2019 - 2024 Capital Improvements Program and funded from various funding sources to include the General Fund, Advanced Transportation District Fund, debt proceeds, or other funding sources.

 

BACKGROUND INFORMATION:

Project Background

During the FY 2019-2020 Budget process, City Council approved $9 million for the Sidewalk Maintenance Program, a component of the Infrastructure Management Program (IMP) and $2 million for Neighborhood Access and Mobility Program (NAMP) to complete sidewalk and pedestrian-related projects. The 2017-2022 Bond Program for Sidewalks Improvements delivered in 2018-2019 is estimated to be an additional $10 million. Transportation & Capital Improvements Department (TCI) regularly solicits Task Order Contracts for construction services and utilizes various contractors to complete the construction of street and sidewalk-related projects.    

 

Transportation & Capital Improvements (TCI) began construction of the FY 2019 Sidewalk Maintenance Program utilizing four (4) contracts that were awarded on September 17, 2017. The total contract capacity from FY 2018 contracts totals $4,530,000.00. Table 1 below summarizes the contracts awarded to date for FY 2019.

Procurement of Services

 

A.                     The 2019-2020 Task Order Contract for Flatwork and Street Improvements, Package 1 was advertised for construction bids in August 2018 in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily and on TVSA. Bids for Package 1 were due on September 18, 2018 with five bids received.  MCOR Construction, Company was the lowest responsive bidder.

 

B.                     The 2019-2020 Task Order Contract for Flatwork and Street Improvements, Package 2 was advertised for construction bids in August 2018 in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily and on TVSA. Bids for Package 2 were due on September 25, 2018 with eight bids received.  F.D. Concrete, LLC was the lowest responsive bidder.

 

These contracts will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. Table 1 summarizes the SBEDA goals for each contract.

This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

 

ISSUE:

 

This ordinance authorizes two (2) packages for a contract capacity in the amount of $3,648,090.50 for the construction of the FY 2019-2020 Sidewalk Maintenance Program and the Neighborhood Access and Mobility Program projects.  Additional contracts are scheduled to be awarded at a later date for the remaining budget.

 

These two packages for flatwork and street improvement projects include, but are not limited to, the construction of sidewalks, curbs, wheelchair ramps, street improvements and any other work required for the completion of the assigned projects located throughout the City.  SAWS participation on these packages is necessary in order to allow SAWS to complete adjustments to its existing infrastructure while a City project is under construction.  SAWS will reimburse its improvement costs to the City of San Antonio based on the bid unit prices received per this construction contract. 

 

Task order contracts are utilized when multiple projects are to be delivered through various programs and funding sources in a limited timeline but the specific projects (scope and limits) are not known.  A task order contract is awarded based on the capacity, or total dollar amount, anticipated to deliver a number of projects within a specified limited timeframe.  Funding for these projects may include, but is not limited to the General Fund, Advanced Transportation District (ATD), or other funding sources.

ALTERNATIVES:

As an alternative, City Council could require the projects to be to individually bid out for construction.  However, construction bid prices could be higher than those estimated with the Task Order Contracts and bidding the projects individually would prolong the delivery of these projects.  Additionally, TCI does not have the in-house staff to complete these projects in a timely manner.

 

 

FISCAL IMPACT:

A.                     Requirements for each task shall be detailed in the individual work orders assigned.  If funding for any work activities is not previously appropriated, funding will be identified and appropriated through subsequent City Council action.   

 

Funding in an amount not to exceed $1,927,755.00 is included in the FY 2019 - 2024 Capital Improvements Program and may be funded from various funding sources to include, but not limited to, the General Fund (NAMP), Advanced Transportation District Fund, debt proceeds, or other funding sources.  Funds in the amount of $113,400.00 will be reimbursed by San Antonio Water System (SAWS) for necessary adjustments to its existing infrastructure.  The City makes no guarantees on the volume of work distributed.

 

B.                     Requirements for each task shall be detailed in the individual work orders assigned.  If funding for any work activities is not previously appropriated, funding will be identified and appropriated through subsequent City Council action.

RECOMMENDATION:

Staff recommends approval of these ordinances, awarding the following task order contracts necessary to complete sidewalk-related projects identified in the FY 2019-2020 IMP and NAMP Programs.
