Amendment No. 3 to the License Agreement with McAllister Park Little League

 

 

SUMMARY:

 

This Ordinance authorizes the Parks and Recreation Department to execute Amendment No. 3 to the License Agreement with McAllister Park Little League for operations and maintenance of the upper baseball fields at McAllister Park for a five-year period ending October 31, 2023.

 

 

BACKGROUND INFORMATION:

 

McAllister Park Little League has established a community presence since 1977.  The league utilizes the upper baseball complex at McAllister Park to provide organized youth sports activities year round; the league served over 800 area youth in 2017.

 

On May 10, 2008, Bexar County voters approved an extension of the 1999 hotel occupancy and short term motor vehicle rental tax, referred to as the visitor or venue tax.  Bexar County identified community projects to fund with this tax extension that would have a positive impact on tourism. McAllister Park Little League was selected by Bexar County to receive $2.67 million from the venue tax for the development of a new baseball facility in McAllister Park. On September 18, 2008, the City and McAllister Park Little League entered into a License Agreement Bexar County Venue Tax Projects for approximately 46 acres in McAllister Park for the development of a baseball facility.  The initial term of the license agreement was five years with up to seven five year renewal options subject to City Council approval.  The first amendment to the License Agreement was executed on November 7, 2013, to exercise the first renewal option for a five (5) year term.

 

Amendment No. 3 shall commence upon Council approval and expire October 31, 2023.  In lieu of rent, the league shall be responsible for the operations and maintenance of the baseball complex at McAllister Park.  In addition, the league will be permitted to operate concessions with proceeds benefitting their program and to offset the cost of operations and maintenance.  The amendment includes administrative renewals for the remaining five renewal terms and a Community Programming Responsibility provision.  This provision shall require the McAllister Park Little League to offer a discount to returning youth, host a free select regional tournament, offer a free adaptive sports league and allow field reservations for leagues and general public.

 

 

ISSUE:

 

This ordinance authorizes the Parks and Recreation Department to execute Amendment No. 3 to the License Agreement with McAllister Park Little League at McAllister Park for use of the upper baseball fields. The Agreement will be for a five (5) year term. This action is consistent with City policy to facilitate the use of parks for athletic and recreational activities by the citizens of San Antonio.

 

 

ALTERNATIVES:

 

City Council could elect not to approve this action, resulting in the Parks and Recreation Department maintaining the upper baseball fields at McAllister Park which would have a corresponding budgetary impact.

 

 

FISCAL IMPACT:

 

There is no General Fund impact associated with this action.

 

 

RECOMMENDATION:

 

Staff recommends approval to execute Amendment No. 3 to the License Agreement with McAllister Park Little League for operations and maintenance of the upper baseball fields at McAllister Park.
