SUBJECT:
Appointing a replacement City Councilmember for District 2.
SUMMARY:
On Thursday, December 13, 2018, Councilmember William “Cruz” Shaw resigned as the District 2 City Council Representative. The resignation becomes effective Monday, January 7, 2019.
On Monday, December 17, 2018, at a Special City Council Meeting, the Mayor and Council approved Ordinance 2018-12-17-1046 acknowledging the resignation and initiating procedures to select an interim replacement Councilmember.
The Office of the City Clerk began accepting Applications for the vacancy from the day the Mayor and Council acknowledged the resignation on Monday, December 17, 2018 through 5:00 p.m. on Friday, January 4, 2019.
On Wednesday, January 9, 2019, Applicants will have the opportunity to make a statement on their background and qualifications to represent the District effectively. The City Council may have questions for each Applicant. Applicants will be seated in a separate room until interviewed before the Mayor and Council. Interviews will be conducted in the order Applications were received by the City Clerk. Following the item, the Mayor and Council may select up to 3 Finalists.
At the Regular City Council Meeting scheduled for Thursday, January 10, 2019, the Mayor and City Council may interview the selected Finalists. With at least 8 affirmative votes, the Appointment will take effect immediately. The City Clerk will immediately swear-in the District 2 Councilmember who will take a seat on the Dais.
The Mayor and Council may recess into Executive Session on this matter at any time.
The appointee will hold office until the newly elected District 2 Councilmember takes office.
BACKGROUND INFORMATION:
On Thursday, December 13, 2018, Councilmember William “Cruz” Shaw resigned from his place on the City Council. Said resignation becomes effective Monday, January 7, 2019.
ISSUE:
The District 2 Vacancy is being filled in accordance with the provisions outlined in Section 8 of the City Charter which states that the Mayor and Council may appoint a person to serve as a Councilmember on a temporary basis. City Ordinance 2010-05-06-0375 outlines the procedures for Appointment in the event of a Vacancy.

There is no fiscal impact associated with the passage of this ordinance.
RECOMMENDATION:
The City Clerk recommends City Council interview and appoint a replacement Councilmember for District 2.
