Construction Contract for the Salado Creek Greenway (Loop 1604 to Eisenhower Park) Project

 

 

SUMMARY:

 

This ordinance accepts the lowest qualified bid and awards a construction contract to TCL Construction Enterprises, LLC and authorizes payment in the amount of $3,750,000.00 to perform construction work for the Salado Creek Greenway (Loop 1604 to Eisenhower Park) Project located in Council District 9.  Funding for this project is available from the 2015 Sales Tax Venue funds and is included in the FY 2019 to FY 2024 Capital Improvement Program.

 

This ordinance also authorizes the execution of an access agreement with the Texas Department of Transportation (TxDOT) to allow for the construction and maintenance of trail improvements where they cross TxDOT’s right-of-way.

 

 

BACKGROUND INFORMATION:

 

This ordinance authorizes a construction contract with TCL Construction Enterprises, LLC for the Salado Creek Greenway (Loop 1604 to Eisenhower Park) Project and authorizes the execution of an access agreement with TxDOT to allow for the construction and maintenance of the Salado Creek Greenway improvements within TxDOT’s right-of-way at Loop 1604 and at NW Military Hwy.  Design work was performed by Bain Medina Bain, Inc.  The Salado Creek Greenway (Loop 1604 to Eisenhower Park) Project consists of a 10 foot wide concrete trail, approximately four miles in length and will include trailhead improvements where it connects to Eisenhower Park.  Trailhead amenities include signage, custom paving, and minor landscaping.

 

The proposed project is part of a growing network of interconnected hike and bike trails known as the Howard W. Peak Greenway Trails system, which is funded through sales tax initiatives approved by voters in 2000, 2005, 2010, and 2015.  The objectives of the program are to acquire and preserve open space along San Antonio creekways and to develop multi-use hike and bike trails, trailheads, signage and associated amenities for use by San Antonio residents and visitors.

 

The Request for Low Qualified Bids was advertised the third and fourth weeks of November and the first week of December 2018 in the Hart Beat, the Texas Electronic State Business Daily, the City’s website, and announced on the City’s public access station TVSA.  One (1) bid was received.  After reviewing the bidder’s qualifications, TCL Construction Enterprises, LLC was selected with a qualified bid of $3,750,000.00.  A summary of the bids is shown on Exhibit 1.  It is anticipated that construction will begin in February 2019 and will be completed by Spring of 2020.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program. TCL Construction Enterprises, LLC is a small minority-owned firm that will be self-performing the 24% Minority and/or Women-Owned Business Enterprise (M/WBE) subcontracting goal and has committed to satisfying the 3% African American Business Enterprise (AABE) subcontracting goal.

 

 

ISSUE:

 

This ordinance accepts the lowest qualified bid and awards a construction contract to TCL Construction Enterprises, LLC in the amount of $3,750,000.00, funded from the 2015 Sales Tax Venue funds.  This ordinance also authorizes execution of an access agreement with TxDOT to allow for the construction and maintenance of trail improvements where they cross TxDOT’s right-of-way.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to award this construction contract. However, re-bidding this project is not recommended as this would not guarantee lower bids and would delay the start of construction for this project.

 

 

FISCAL IMPACT:

 

This ordinance authorizes one-time capital improvement expenditure in the amount of $3,750,000.00 payable to TCL Construction Enterprises, LLC for the Salado Creek Greenway (Loop 1604 to Eisenhower Park) Project located in Council District 9.  Funding in the amount of $3,750,000.00 is available from 2015 Sales Tax Venue funds and is included in the FY 2019 to FY 2024 Capital Improvement Program.  Funding for operation and maintenance of the city-wide greenway trail system is submitted annually as part of the General Fund budget process as trail miles are completed.

 

There is no fiscal impact associated with the TxDOT access agreement to allow for the construction and maintenance of trail improvements within TxDOT right-of-way.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance to accept the lowest qualified bid and award a construction contract to TCL Construction Enterprises, LLC in the amount of $3,750,000.00.  This construction contract was developed utilizing the formal competitive bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

Staff also recommends approval of the execution of an access agreement with TxDOT to allow for the construction and maintenance of trail improvements within TxDOT right-of-way.
