SUBJECT:

Amendment #1 to the Lease Agreement with The Public Theater of San Antonio


SUMMARY:

This ordinance authorizes the execution of Amendment #1 to exercise the first renewal option of the Lease Agreement with The Public Theater of San Antonio for management and operations of the San Pedro Playhouse within San Pedro Springs Park for a term of 10 years beginning on May 31, 2019 and expiring on May 31, 2029.


BACKGROUND INFORMATION:

The Public Theater of San Antonio was established in 1912 as the San Antonio Dramatic Club and became incorporated in 1927 as the San Antonio Little Theater. Although the theater has undergone many name changes, it remains the most historic theater in South Texas. In 1958, a formal lease agreement for use of the San Pedro Playhouse was established between the City and, currently known as, The Public Theater of San Antonio.

On May 19, 1994, the City and The Public Theater entered into a Lease Agreement for the San Pedro Playhouse located in San Pedro Springs Park. The initial term of the Lease Agreement was 25 years, expiring May 30, 2019, with two (2) ten year extensions.

The lease agreement requires that the tenant be compliant with the terms and conditions and request to exercise the 10-year renewal; all contractual conditions have been met. Additionally, The Public Theater of San Antonio is planning capital improvements located on the lease premises. The improvements are consistent with the contract terms, which require The Public Theater to maintain and improve the premises at their cost. In lieu of rent, the tenant shall be responsible for management and operations of the San Pedro Playhouse, including interior maintenance and preventative maintenance of the building and utility usage. All other terms and conditions of the current Lease Agreement will remain in effect.
