Amendment #4 to the Softball Lease and Management Agreement with San Antonio Amateur Softball Association (USA Softball San Antonio)

 

 

SUMMARY:

 

This Ordinance authorizes Amendment #4 to extend the term of the Softball Lease and Management Agreement with the San Antonio Amateur Softball Association for the management, operations and maintenance of designated softball complexes until June 30, 2022.

 

 

BACKGROUND INFORMATION:

 

The San Antonio Amateur Softball Association (USA Softball San Antonio) is a non-profit organization established in 1959 and the local affiliate of the USA Softball, whose purpose is to organize, promote and further amateur softball in San Antonio.  On May 31, 2012, City and USA Softball San Antonio entered into a Softball Lease and Management Agreement for the management, operation and maintenance of the City’s Class A softball complexes and adult softball program.  The complexes include: Kennedy Softball Complex in Kennedy Park; Koger Stokes Softball Complex in San Pedro Springs Park; and Alva Jo Fischer Softball Complex in Lady Bird Johnson Park.  The initial term of the license agreement was seven years beginning July 1, 2012, and ending June 30, 2019, with one three-year extension term until June 30, 2022.

 

On September 20, 2012, City and USA Softball San Antonio executed Amendment # 1 to this Agreement to allow for administrative corrections and to allow USA Softball San Antonio to enter into sponsorship agreements.  On November 21, 2013, Amendment #2 was executed to incorporate food and beverage concessions functions into the existing agreement.  On September 18, 2014, Amendment #3 was executed to transfer the City’s Youth Softball program to USA Softball San Antonio. 

 

The 2017 Bond Program includes improvements to San Pedro Springs Park scheduled to begin this Fall.  The project will modify the amenities in the park which will eliminate Koger Stokes Complex which is currently under the leased premises to USA Softball San Antonio. 

 

Amendment #4 shall commence on July 1, 2019, and expire June 30, 2022.  Additionally, this action will remove the licensed area at San Pedro Springs Park known as Koger Stokes Softball Complex.  In lieu of rent, the league shall be responsible for operations and maintenance of the Kennedy Softball Complex and Alva Jo Fisher Softball Complex.  In addition, the league will be permitted to operate concessions with proceeds benefitting their program and to offset the cost of operations and maintenance.  All other terms and conditions of the current Lease and Management Agreement will remain in effect.

 

 

ISSUE:

 

This Ordinance authorizes Amendment #4 to extend the term of the Softball Lease and Management Agreement with the San Antonio Amateur Softball Association for the management, operations and maintenance of designated softball complexes until June 30, 2022.  This action is consistent with City policy to facilitate the use of parks for athletic and recreational activities by the citizens of San Antonio.

 

 

ALTERNATIVES:

 

City Council could elect not to approve this action, resulting in the Parks and Recreation Department maintaining the designated softball complexes at Kennedy Park and Lady Bird Johnson Park, which would have a corresponding budgetary impact.

 

 

FISCAL IMPACT:

Staff recommends approval of Amendment #4 to extend the term of the Softball Lease and Management Agreement with the San Antonio Amateur Softball Association for the management, operations and maintenance of designated softball complexes until June 30, 2022.
