SUBJECT:

 

Contribution Agreement & Contract Award: West Military Drive & Ingram Connectors

 

 

SUMMARY:

 

Consideration of the following items related to the West Military Drive & Ingram Road Connectors, a FY 2019 Capital Improvement Program funded project, located in Council District 6:

 

A.                     An ordinance authorizing the execution of a Contribution Agreement with Civita S Corp 2019 which will contribute right-of-way and all engineering costs associated with the project for a value of $3,922,529.94.  

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $7,736,268.70 to E-Z Bel Construction, LLC; of this total contract amount, funds in the amount not to exceed $6,511,671.68 will be funded by the City and funds in the amount not to exceed $1,224,597.02 will be reimbursed by the San Antonio Water System (SAWS).

 

 

BACKGROUND INFORMATION:

 

Project Background

On May 6, 2017, San Antonio voters approved the 2017-2022 Bond Program, consisting of six propositions totaling $850 Million to be used on various capital improvement projects to address community infrastructure needs and improve the overall quality of life in San Antonio.  As part of Proposition 1 Streets, Bridges & Sidewalk Improvements, funds in the amount of $10,000,000.00 associated with the West Military Drive & Ingram Road Connectors Project and $1,000,000.00 for the Ingram Road (Potranco Road to Dead End) were approved for improvements associated with West Military Drive & Ingram Road Connectors Project.

 

Procurement of Services

This project was advertised for construction bids in the San Antonio Hart Beat, on the City’s website, Civcast, and the Texas Electronic State Business Daily in March 2019.  In addition, the bid announcement was made on TVSA and through the Small Business Economic Development Advocacy (SBEDA) Office.  Plans were available for review by potential bidders at the office of KFW Engineers and Surveying, located at 3421 Paesanos Parkway San Antonio, Texas 78231. Bids for this project were opened on April 30, 2019 and six (6) bidders responded.  Of these, E-Z Bel Construction, LLC submitted the lowest responsive bid.  A matrix of the bid outcome is included herein.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 30% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 2% African American Business Enterprise (AABE) subcontracting goal.  E-Z Bel Construction, LLC has committed to meeting these goals.


This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required

 

 

ISSUE:

 

This ordinance requests the following items related to the West Military Drive & Ingram Road Connectors, a 2017 - 2022 General Obligation Bond funded Project, located in Council District 6:

 

A. This ordinance authorizes the execution of a Contribution Agreement with Civita S Corp 2019 which will contribute right-of-way and all engineering costs for a value of $3,922,529.94.

 

B. This ordinance accepts the lowest responsive bid and awards a construction contract in the amount of $7,736,268.70 to E-Z Bel Construction, LLC; of this total contract amount, funds in the amount not to exceed $6,511,671.68 will be funded by the City and funds in the amount not to exceed $1,224,597.02 will be reimbursed by the San Antonio Water System (SAWS).

 

The scope of the project will provide for the construction of a road extension of West Military Drive and Ingram Road to include curbs, sidewalks, bike facilities, an intersection, a traffic signal and drainage improvements.

 

Project construction is anticipated to begin in August 2019 and is estimated to be completed by August 2020.

 

Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2017-2022 General Obligation Bond funded projects.

 

 

ALTERNATIVES:

 

A.                     City Council could choose not to approve the Contribution Agreement; however, without the Civita S Corp 2019 as a partner, the City would have to purchase right-of-way and find additional funding to cover engineering fees and construct the project.

 

B.                     As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project; however, re-advertising this project does not guarantee a lower bid considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project. 

 

 

FISCAL IMPACT:

 

A.                     This ordinance will authorize acceptance of the Contribution Agreement valued at $3,922,529.94 for the right-of-way and all engineering services for improvements towards completion of the Project.

 

B.                     This is a one-time capital improvement expenditure in the amount of $7,736,268.70 authorized payable to E-Z Bel Construction, LLC; of this total contract amount, funds in the amount not to exceed $6,511,671.68 will be funded by the City and funds in the amount not to exceed $1,224,597.02 will be reimbursed by the San Antonio Water System (SAWS).  Funds are available from 2017-2022 General Obligation Bond and are included in the FY 2019 - 2024 Capital Improvement Budget.

 

 

RECOMMENDATION:

 

Staff recommends approval of the following items related to the West Military Drive & Ingram Connectors:

 

A.                     An ordinance authorizing the execution of a Contribution Agreement with Civita S Corp 2019 for the right-of-way and all engineering services valued at $3,922,529.94.

 

B.                     Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $7,736,268.70 to E-Z Bel Construction, LLC for construction of the project.
