SUBJECT:

 

Donation Agreement & Contract Award:  Applewhite Road Intersection (South of Watson Road)

 

 

SUMMARY:

 

Consideration of the following items related to the Applewhite Road Intersection (South of Watson Road) Project, 2017-2022 Bond funded project, located in Council District 3:

 

A.                     An ordinance authorizing the execution of a Donation Agreement with Hanford-Southport, LLC and Avanzar Interior Technologies, LTD in the amount of $200,000.00 for the construction of the Applewhite Road Intersection (South of Watson Road) Project. 

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract including an additive alternate in the total amount of $976,587.79 to E-Z Bel Construction, LLC for the Applewhite Road Intersection (South of Watson Road) Project.

 

 

BACKGROUND INFORMATION:

 

On May 6, 2017, San Antonio voters approved the 2017-2022 Bond Program, consisting of six propositions totaling $850 Million to be used on various capital improvement projects to address community infrastructure needs and improve the overall quality of life in San Antonio.  As part of Proposition 1 Streets, Bridges & Sidewalk Improvements, funds in the amount of $1,000,000.00 were approved for improvements associated with the Applewhite Road Intersection (South of Watson Road) Project.

 

The project will provide for the reconstruction and widening of the west side of Applewhite Road to accommodate dual left turn lanes from Applewhite Road southbound to the entrance south of Watson Road.  Additionally, the additive alternate will further widen the proposed base bid improvements on the west side of Applewhite Road to accommodate a southbound right turn lane into a stub-out for a future four-legged intersection.  Traffic signalization will be redesigned to accommodate changes. 

 

Procurement of Services

This project was advertised for construction bids on May 8, 2019 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA and through the TCI Small Business Economic Development Advocacy (SBEDA) Office.  Plans were available to potential bidders through the CIVCAST electronic bidding site.  Bids for this Project were opened on June 11, 2019 and four bids were received.  Of these, E-Z Bel Construction, LLC submitted the lowest responsive bid.  A summary of the bid outcome is included as an attachment.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 21% Minority/Women Business Enterprise (M/WBE) and a 1% African-American Owned Business Enterprise (AABE) subcontracting goal.  E-Z Bel Construction, LLC has agreed to meet the subcontracting goals.


This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

 

ISSUE:

 

Consideration of the following items related to the Applewhite Road Intersection (South of Watson Road) Project, 2017-2022 Bond funded project, located in Council District 3:

 

A.                     This ordinance authorizes the execution of a Donation Agreement with Hanford-Southport, LLC and Avanzar Interior Technologies, LTD in the amount of $200,000.00 for the construction of the Applewhite Road Intersection (South of Watson Road) Project.

 

The execution of the Donation Agreement is necessary to ensure full funding for the construction of the Applewhite Road Intersection (South of Watson Road) Project. 

 

B.                     This ordinance accepts the lowest responsive bid and awards a construction contract including an additive alternate in the total amount of $976,587.79 to E-Z Bel Construction, LLC for the Applewhite Road Intersection (South of Watson Road) Project.

ALTERNATIVES:

 

A.                     As an alternative, City Council could choose not to approve the Donation Agreement; however, without the Hanford-Southport, LLC and Avanzar Interior Technologies, LTD as partners, the City would have to find additional funding to complete construction of the improvements on the west side of Applewhite Road. 

 

B.                     As an alternative, City Council could choose not to award this contract and require staff to re-advertise the project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project.

 

 

FISCAL IMPACT:

 

A.                     This ordinance authorizes the acceptance of a donation from Hanford-Southport, LLC and Avanzar Interior Technologies, LTD in the amount of $200,000.00.  The FY 2019- FY 2024 Capital Improvement Budget will be increased to reflect the addition of funds in the amount of $200,000.00 to supplement funds approved in the 2017 Bond Program for the Applewhite Road Intersection (South of Watson Road) Project.

 

B.                     This is a one-time capital improvement expenditure in the total amount of $976,587.79 payable to E-Z Bel Construction, LLC.  Funds are available from the 2017-2022 General Obligation Bond Program and are included in the FY 2019- FY 2024 Capital Improvement Program Budget; and, upon approval the acceptance of a donation in the amount of $200,000.00.

 

 

RECOMMENDATION:

 

Staff recommends approval of the following items related to the Applewhite Road Intersection (South of Watson Road) Project: 

 

A.                     An ordinance authorizing the execution of a Donation Agreement with Hanford-Southport, LLC and Avanzar Interior Technologies, LTD in the amount of $200,000.00 for the construction of Applewhite Road Intersection (South of Watson Road) Project.

 

B.                     An ordinance accepting the lowest responsive bid and awarding a construction contract including an additive alternate in the total amount of $976,587.79 payable to E-Z Bel Construction, LLC for construction of the Applewhite Road Intersection (South of Watson Road) Project.
