Funding Agreement Amendment & Contract Award:  Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing)

 

 

SUMMARY:

 

Consideration of the following items related to Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing), a 2017 Bond funded project, located in Council District 3:

 

A. An ordinance authorizing the execution of an amendment to the Funding Agreement between the City of San Antonio and the Brooks Development Authority in the increase amount not to exceed $352,000.00 for the acceptance of funds from the Brooks Development Authority to the City of San Antonio for construction of the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project, a 2017 Bond funded project.

 

B. An ordinance accepting the lowest responsive bid and awarding a construction contract including two additive alternates in the amount not to exceed $7,877,687.15 payable to J3 Company, LLC for construction of the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project, a 2017 Bond funded project. 

 

 

BACKGROUND INFORMATION:

 

On May 6, 2017 voters approved the 2017 Bond Program which authorized $10,400,000.00 for street improvements to Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project located in Council District 3.  The project provides for the extension of South New Braunfels south of the Research Plaza intersection to Lyster Road, the realignment and widening of Lyster Road from South New Braunfels to Aviation Landing and associated utility improvements.

 

Project construction is anticipated to begin in September 2019 and estimated to be completed by October 2020.

 

Procurement of Services

This project was advertised on March 15, 2019 for construction bids in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily, on TVSA, through the electronic bidding site CIVCAST and through the TCI Small Business Office.  Bids were opened on April 16, 2019 and four (4) bids were received.  Of these, J3 Company, LLC submitted the lowest responsive bid.  A matrix of the bid outcome is included herein.

 

This contract will be awarded in compliance with the new Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts to be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority and women-owned business participation on the contract. The Goal Setting Committee set a 14% Minority/Women Business Enterprise (M/WBE) subcontracting goal.  J3 Company, LLC has committed to meeting the subcontractor participation goal.

 

Previous Council Action

On November 15, 2018, City Council approved the Funding Agreement between the City of San Antonio and the Brooks Development Authority through Ordinance 2018-11-15-0906.  This will be the first amendment to the Funding Agreement and it will increase the Funding Agreement by $352,000.00 for a revised Funding Agreement amount of $2,916,948.31.

This construction contract was developed utilizing the low bid process.  Therefore, a Contracts Disclosure Form is not required.

 

 

ISSUE:

 

Consideration of following items related to Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing), a 2017 Bond funded project, located in Council District 3:

 

A.                     This ordinance authorizes the execution of an amendment to the Funding Agreement between the City of San Antonio and the Brooks Development Authority in the increase amount not to exceed $352,000.00 for the acceptance of funds from the Brooks Development Authority to the City of San Antonio for construction of the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project, a 2017 Bond funded project.

Based on the high bid prices received for construction of Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project, funds are needed to ensure construction of this project is fully funded.  This amendment will authorize the acceptance of funds in the additional amount of $352,000.00 from the Brooks Development Authority for the construction of this Project.

 

B.                     This ordinance accepts the lowest responsive bid and awards a construction contract including two additive alternates in the amount not to exceed $7,877,687.15 payable to J3 Company, LLC for construction of the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project, a 2017 Bond funded project. 

 

The project will provide for the extension of South New Braunfels south of the Research Plaza intersection to Lyster Road, the realignment and widening of Lyster Road from South New Braunfels to Aviation Landing and associated utility improvements.  The additive alternates will provide for the replacement of asphalt pavement with concrete pavement and the construction of an underground duct bank. This project will provide connectivity to surrounding areas when completed.

 

Project construction is anticipated to begin in September 2019 and estimated to be completed by October 2020.

 

 

ALTERNATIVES:

 

A.                     As an alternative, City Council could choose not to approve this amendment; however, without the acceptance of the additional funding from the Brooks Development Authority the construction of the project will not be fully funded and the proposed improvements for the Brooks City Base South New Braunfels Project will not be constructed. 

 

B.                     As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project.

 

 

FISCAL IMPACT:

 

A.                     This ordinance authorizes the acceptance of additional funds in the amount not to exceed $352,000.00 from Brooks Development Authority to be used toward the construction of Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project The FY 2019 - FY 2024 Capital Improvement Budget will be amended to reflect additional funds in the amount not to exceed $352,000.00 to supplement funds for the construction of the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project.

 

B.                     This is one-time capital improvement expenditure in the amount not to exceed $7,877,687.15 authorized payable to J3 Company, LLC for the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing) Project.  Funds are available from the 2017 General Obligation Bond Program and are included in the FY 2019 - FY 2024 Capital Improvement Program Budget.

 

 

RECOMMENDATION:

 

Staff recommends approval of the following items related to the Brooks City Base South New Braunfels Avenue (Lyster Road to Aviation Landing), a 2017 Bond funded project, located in Council District 3:
