Concealable Body Armor for SAPD and Other Law Enforcement Officers

 

 

SUMMARY:

 

This ordinance authorizes the execution of a three year contract with Nardis, Inc. to provide the San Antonio Police Department and other law enforcement officers with concealable body armor utilized in day to day operations by authorized personnel for an estimated annual cost of $443,000.00 in FY 2020. There are also two additional one-year renewal options.  The total contract value is $2,212,198.54. Funding is available in the FY 2020 Adopted Budget in the General Fund and Airport Operating and Maintenance Fund. Funding for future years is subject to council authorization.

 

BACKGROUND INFORMATION:

 

Submitted for Council consideration and action is a proposal submitted by Nardis, Inc. to provide concealable body armor utilized in day to day operations by authorized personnel from the San Antonio Police Department, Park Police, Aviation Police and Fire Department. These vests are to be issued as standard equipment to officers for daily wear as protection under uniforms against ballistic threats. Concealable body armor periodically requires replacement every five years or when its integrity is compromised through normal wear and tear.

 

The City of San Antonio issued a Request for Proposals (RFP) for “Concealable Body Armor for SAPD and Other Law Enforcement Officers” (RFP 19-029) on February 27, 2019. Two proposals were received on March 29, 2019, and were deemed eligible for evaluation.

 

The RFP set forth minimum requirements inclusive of vest composition, design, trauma reduction, fitting, labeling, warranty, liquidated damages, and quality control requirements. Specifications also included compliance with National Institute of Justice (NIJ) and Military (MIL) standards including:  NIJ-STD-0101.06, MIL-C-7219D, MIL-F-21840, MIL-T-43548 and MIL-STD-662F.

 

The evaluation process included the following components and evaluation sessions:

 

° Minimum requirements review for compliance with specifications

° Fitting Session: Seven (7) testing Officers were outfitted by respondent’s personnel

° Fitted sample vests were received

° Shoot Tests: Conducted by SAPD Armorer on randomly selected vest samples

° If shooting tests were successful, vest progressed to wear test

° Wear Test: Officer participated in wear test, surveys collected and tabulated

° Scoring Meeting was conducted

 

The Evaluation Committee met on October 21, 2019, to review, evaluate and score the two proposals received. The Evaluation Committee included representatives from the SAPD Labor Relations Committee (LRC). Proposals were evaluated and scored based on the published evaluation criteria in the RFP which included:  Experience, Background, Qualifications (10 points), Proposed Plan (55 points), Price (10 points), Small Business Enterprise (SBE) Prime Contract Program (10 points), Local Preference Program (10 points), and the Veteran-Owned Small Business Preference Program (5 points).

 

After all discussions and scoring were completed by the Evaluation Committee, the highest ranked firm, Nardis, Inc., was selected for award recommendation. 

 

 

ISSUE:

 

The Collective Bargaining Agreement between the City of San Antonio and the San Antonio Police Officers Association; Article 10, Section 5, requires all officers be provided with a protective vest. As is typical in in procurements of equipment for use by police officers, the Labor Relations Committee appointed personnel to conduct testing and provide findings for a recommendation of award.

 

This procurement is made by means of a Public Health or Safety Exemption to competitive bidding in order to set forth strict minimum requirements and allow flexibility in the evaluation process to include wear test surveys and a shooting test. 

 

The initial term of this contract is for a three year period upon City Council approval.  Two additional one year renewals at the City’s option shall also be authorized by this ordinance.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee applied the Small Business Enterprise Prime Contract Program with ten (10) evaluation preference points to this contract.

 

In accordance with the Local Preference Program, the recommended respondent received 5 points for having a local office in the incorporated San Antonio city limits for the requisite time period, and with the requisite number of employees.

 

There were no proposals submitted from Veteran-Owned Small Businesses for this contract. 

 

 

 

ALTERNATIVES:

 

Should this contract not be approved, SAPD will be required to purchase concealable body armor for uniformed police on an as needed basis wherein increased costs due to non-contract buying may be realized.

 

 Lack of a contract could also affect delivery times for this equipment which is required to carry out Police operations and could impact the safety and welfare of the officers and City Residents.

 

 

FISCAL IMPACT:

This contract was procured by means of a Request for Proposal and a Contracts Disclosure Form is required.
