Contribution Agreement Amendment: West Military Drive & Ingram Road Connectors 

 

 

SUMMARY:

 

An ordinance authorizing the execution of an amendment to a Contribution Agreement between the City of San Antonio and Civita S Corp 2019 in the amount not to exceed $300,000.00 for the payment from the City of San Antonio to Civita S Corp 2019 for reimbursement of construction phase engineering services related to the West Military Drive & Ingram Road Connectors project, a 2017 Bond funded project, located in Council District 6.

 

 

BACKGROUND INFORMATION:

 

Project Background

On May 6, 2017, San Antonio voters approved the 2017-2022 Bond Program, consisting of six propositions totaling $850 Million to be used on various capital improvement projects to address community infrastructure needs and improve the overall quality of life in San Antonio.  As part of Proposition 1 Streets, Bridges & Sidewalk Improvements, funds in the amount of $10,000,000.00 associated with the West Military Drive & Ingram Road Connectors Project and $1,000,000.00 for the Ingram Road (Potranco Road to Dead End) were approved for improvements associated with West Military Drive & Ingram Road Connectors Project. 

 

The project supports the thoroughfare plan extension of W. Military Drive connecting from Potranco Road, including the extension of Ingram Road to Potranco. The project will include street, curbs, sidewalks, bike facilities, an intersection, a traffic signal and drainage improvements.  Project Construction began in July 2019 and is estimated to be complete by July 2020.

 

Previous Council Action

A previously executed Contribution Agreement with Civita S Corp 2019 for the West Military Drive & Ingram Road Connectors project pursuant to which Civita S Corp 2019 contributed right-of-way and engineering costs and the City provided construction in the amount of $11,000,000.00 was approved by City Council on June 20, 2019 through Ordinance 2019-06-20-0536.  This amendment will provide for the City to pay Civita S Corp 2019 a not to exceed amount of $300,000.00 for reimbursement of construction phase engineering services as a part of the $11,000,000.00 construction obligation.

 

 

ISSUE:

 

This ordinance authorizes the execution of an amendment to a Contribution Agreement between the City of San Antonio and Civita S Corp 2019 in the amount not to exceed $300,000.00 for the payment from the City of San Antonio to Civita S Corp 2019  for reimbursement of construction phase engineering services related to the West Military Drive & Ingram Road Connectors project, a 2017 Bond funded project, located in Council District 6.

 

As part of the Contribution Agreement, Civita S Corp 2019 was contributing all of the necessary right-of-way and associated engineering costs; and, the City of San Antonio would manage and fund construction of roadway improvements of the West Military Drive and Ingram Road Connectors project.  This amendment will allow City of San Antonio to reimburse Civita S Corp 2019 in the amount of $300,000.00 for construction phase engineering services.  The $300,000.00 will be funded as part of $11,000,000.00 that City has already allocated for construction of this project. 

 

 

ALTERNATIVES:

 

City Council could choose not to approve this ordinance; however this would not allow the City to reimburse Civita S Corp 2019 for construction phase engineering services expenses which arise from the project.

 

 

FISCAL IMPACT:

This is a one-time capital improvement expenditure in the amount of $300,000.00 authorized payable to Civita for construction phase engineering services expenses related to the West Military Drive & Ingram Road Connectors project.  Funds are available from 2017-2022 General Obligation Bond and are included in the FY 2020 - 2025 Capital Improvement Budget.

 

 

RECOMMENDATION:

 

Staff recommends approval of an amendment to the contribution agreement between the City of San Antonio and Civita S Corp 2019 in an amount not to exceed $300,000.00 for construction phase engineering services expenses related to the project.
