Contract Award:  Martin Luther King Plaza (2017 Bond Project)

 

 

SUMMARY:

 

An ordinance accepting the lowest responsive bid and awarding a construction contract including four additive alternates to Industrial Construction Co. in the amount of $403,892.75 for the Martin Luther King Plaza project, a 2017 Bond funded project, located in Council District 2. Funds are available from the 2017 General Obligation Bond Program and are included in the FY 2020 - 2025 Capital Improvement Program Budget. This ordinance will authorize the appropriation of $40,250.00 from the Tree Canopy Preservation and Mitigation Fund for the Martin Luther King Plaza project.

 

 

BACKGROUND INFORMATION:

 

Project Background

On May 6, 2017, voters approved the 2017 Bond Program which authorized $650,000.00 for Martin Luther King Plaza improvements.  The project will provide for the installation of new accessible paving in the plaza, the addition of quotes from Dr. Martin Luther King Jr.’s speeches etched in bands of paving, landscaping, and the cleaning of the existing Dr. King bronze monument. The additive alternates accepted as part of this contract include hardscaping the north plaza low walls, palm tree planting in the north plaza, enhanced paving throughout the plaza and upgraded metal letter quotes from Dr. King’s speeches. Construction is anticipated to begin in April 2020 and estimated to be completed by October 2020.

 

Procurement of Services

This project was advertised for construction bids on October 23, 2019 in the San Antonio Hart Beat, on the City’s website, on the Texas Electronic State Business Daily, on the TCI Small Business Office, on CIVCAST electronic bidding site and on TVSA.  Bids were opened on November 19, 2019 and two (2) bids were received. Of these, Industrial Construction Co. submitted the lowest responsive bid. A matrix of the bid outcome is included herein.

 

This contract will be awarded in compliance with the new Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts to be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority and women-owned business participation on the contract. The Goal Setting Committee set a 26% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 4% African-American Business Enterprise (AABE) subcontracting goal. Industrial Construction Co. has committed to meeting the subcontractor participation goal.

 

This construction contract was developed utilizing the low bid with qualifiers process.  Therefore, a Contracts Disclosure Form is not required.

 

 

ISSUE:

ALTERNATIVES:

 

As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project.

 

 

FISCAL IMPACT:

 

This is one-time capital improvement expenditure in the amount of $403,892.75 payable to Industrial Construction Co.  Funds are available from the 2017 General Obligation Bond Program and are included in the FY 2020 - 2025 Capital Improvement Program Budget. This ordinance will authorize the appropriation of $40,250.00 from the Tree Canopy Preservation and Mitigation Fund for the Martin Luther King Plaza project.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract including four additive alternates in the amount of $403,892.75 to Industrial Construction Co. for construction of the Martin Luther King Plaza project.
