Contract Award: 2020 - 2021 Non-Service Alley Improvements Task Order Contract

 

 

SUMMARY:

 

An ordinance accepting the lowest responsive bid and approving a 2020-2021 Non-Service Alley Improvements Task Order Contract with ACE CO in an amount not to exceed $1,795,961.75 for the construction, repair and maintenance of non-service alleys and related storm water improvements located citywide.

 

 

BACKGROUND INFORMATION:

 

Task Order Contracts are utilized when multiple projects are to be delivered through various programs and funding sources within a limited timeline and specific projects (scope and limits) are not initially known.  These contracts are advertised with an estimated quantity of work and the unit prices are established by the bidding contractor for the duration of the contract.

 

The 2020-2021 Non-Service Alley Improvements Task Order Contract was solicited to provide unit pricing for the construction, repair and maintenance of non-service alleys and related storm water improvements throughout the City.

Procurement of Services

This contract was advertised for construction bids on January 31, 2020 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA, through the electronic bidding site CIVCAST and through the TCI Small Business Economic Development Advocacy (SBEDA) Office.  Bids for this project were opened on March 3, 2020 and four bidders responded. Of these, ACE CO submitted the lowest responsive bid.

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 10% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 2% African American Business Enterprise (AABE) Subcontracting Goal. ACE CO has committed to these goals set by the Small Business Economic Development Advocacy (SBEDA) Program.

 

This task order construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.

 

 

ISSUE:

 

The ordinance accepts the lowest responsive bid and approves a 2020 - 2021 Non-Service Alley Improvements Task Order Contract with ACE CO in an amount not to exceed $1,795,961.75 for the construction, repair and maintenance of non-service alleys and related storm water improvements located citywide.

 

This Task Order contract will be utilized on an as-needed basis to expedite the construction, repair and maintenance of non-service alleys and related storm water improvements located throughout the City.

 

 

ALTERNATIVES:

 

As an alternative, staff can be directed to individually bid out each project for construction.  However, the construction bid prices may be greater than those estimated with the Task Order Contract and bidding projects individually could prolong the delivery of these projects.

 

 

FISCAL IMPACT:

 

This ordinance approves a task order contract with ACE CO in an amount not to exceed $1,795,961.75 for the 2020-2021 Non-Service Alley Improvements Task Order Contract.  Funds are available and included in the FY 2020 Adopted Operating and Capital Budget and may be funded from various funding sources to include, but not limited to, Storm Water Revenue Bonds, Storm Water Operating Funds, Storm Water Regional Facilities Funds, and General Funds.

 

Requirements for each task shall be detailed in the individual task orders assigned. The City makes no minimum guarantee pertaining to the volume of work. All expenditures will be in accordance with the FY 2020 Adopted Operating and Capital Budget approved by City Council. Future fiscal year expenditures are contingent upon Council’s approval of the annual budget.

 

 

RECOMMENDATION:

 

Staff recommends the approval of 2020-2021 Non-Service Alley Improvements Task Order Contract with ACE CO in an amount not to exceed $1,795,961.75 for the construction, repair and maintenance of non-service alleys and related storm water improvements located citywide.
